Title

Amending Toledo Municipal Code Section 142.01(b) for the purpose of reducing the number of board members of the Toledo/Lucas County Commission on Disabilities; and declaring an emergency.

SUMMARY & BACKGROUND:

Toledo Municipal Code Chapter 142 establishes the Toledo/Lucas County Commission on Disabilities. Toledo Municipal Code Section 142.01(b) establishes the Commission’s governing board jointly with the Mayor subject to confirmation by Council of the appointment of no more than eleven (11) volunteer members with the Lucas County Commissioners appointing no more than ten (10) volunteer members for a total of twenty-one (21) members. At the recommendation of the current Toledo/Lucas County Commission on Disabilities Board, it is recommended that the total number of board members be reduced from twenty-one (21) to seventeen (17) with nine (9) of the members being appointed by the Mayor subject to confirmation by Toledo City Council, and the remaining eight (8) members appointed by the Lucas County Commissioners. This ordinance amends Toledo Municipal Code 142.01(b) for the purpose of reflecting this reduction.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                                          SECTION 1.  That Toledo Municipal Code Section 142.01(b) which currently states as follows:

 

                     (b)   Appointment of Members; Term. The Mayor, subject to confirmation by the Toledo City Council, shall appoint no more than eleven 11 volunteer members to the Toledo/Lucas County Commission on Disabilities. Emphasis for appointments to the Lucas County Commission on Disabilities shall be on appointing individuals with disabilities and/or immediate family members of individuals with disabilities. The remainder of the City of Toledo appointments shall be representatives of public/private service organizations or other appropriate members of the community. The Lucas County Board of Commissioners shall appoint no more than ten (10) volunteer members to serve on the Toledo/Lucas County Commission on Disabilities together with those members appointed by the City of Toledo. Terms of appointment shall be three-year terms with three term limits, with existing members of the Commission on Disabilities serving the remainder of existing terms. All three-year terms shall expire on February 28 of third year after appointment.

                     SECTION 2.  That a new Toledo Municipal Code Section 142.01(b) is enacted as follows:

                     (b)   Appointment of Members; Term. The Mayor, subject to confirmation by the Toledo City Council, shall appoint no more than nine (9) volunteer members to the Toledo/Lucas County Commission on Disabilities. Emphasis for appointments to the Lucas County Commission on Disabilities shall be on appointing individuals with disabilities and/or immediate family members of individuals with disabilities. The remainder of the City of Toledo appointments shall be representatives of public/private service organizations or other appropriate members of the community. The Lucas County Board of Commissioners shall appoint no more than eight (8) volunteer members to serve on the Toledo/Lucas County Commission on Disabilities together with those members appointed by the City of Toledo. Terms of appointment shall be three-year terms with three term limits, with existing members of the Commission on Disabilities serving the remainder of existing terms. All three-year terms shall expire on February 28 of third year after appointment.

 

                     SECTION 3.  That this ordinance is hereby declared to be an emergency measure and shall be in force and effect from and after its adoption. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of public peace, safety and property, and for further reason that changes to the Toledo/Lucas County Commission on Disabilities is immediately needed to effectively maintain and approve the Board’s management and operation.
