Title

Authorizing the appropriation and expenditure of $179,825 from the Sewer Replacement Fund for emergency repairs to restore functional capacity of the solids handling process at the Water Reclamation plant; authorizing the Mayor to enter into an emergency repair contract with Kokosing Mosser Joint Venture for said purpose; waiving the competitive provisions of TMC Chapter 187; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

Solids handling is critical at the City of Toledo Department of Public Utilities Division of Water Reclamation Bayview Water Reclamation Facility. A critical part of the treatment to protect the environment from potential pollution by sanitary sewage is the removal of biosolids created by treatment processes at the facility. The removal process often causes a mineral scale, primarily formed of magnesium, known as struvite or vivianite, to build up on the walls of process piping. Over time, the buildup of scale reduces the effective diameter of piping in the solids handling process. Recently, the diameter was reduced to a critical point at which the facility was no longer able to process the solids and as quickly as they were being created, thus backing up the solids handling facility. The initial plan to correct this was to replace all the effected lines with new pipe to restore capacity. Kokosing Mosser Joint Venture advised their estimates to perform this work was approaching $750,000. Alternate methods were investigated and successfully implemented in a collaborative approach to address the problem. Methods used included chemical treatment to dissolve the pipe deposits and implementation of more advanced pipe cleaning methods including techniques using chain flails and jet rodding.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1.                     That the appropriation of $179,825 from the unappropriated balance of the Sewer Replacement Fund is authorized to Account Code 6073-36000-4UC4123STDSTD for emergency repairs to restore functional capacity of the solids handling process at the Water Reclamation plant; and the expenditure of the same is authorized.

SECTION 2.                     That the mayor is authorized to enter into an emergency repair contract with Kokosing Mosser Joint Venture for emergency repairs to restore functional capacity of the solids handling process at Water Reclamation plant, upon terms and conditions approved by the Director of Public Utilities and the Director of Law.

SECTION 3. That this Council finds and determines that the competitive provisions of TMC Chapter 187 are waived for the reason that Kokosing Mosser Joint Venture indicated their readiness to proceed with emergency repairs to restore functional capacity of the solids handling process.

SECTION 4. That the Finance Director is authorized to issue warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $179,825 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to pay Kokosing Mosser Joint Venture for emergency repairs to restore functional capacity for piping systems in the Water Reclamation Solids Handling Process.
