SUMMARY & BACKGROUND:
The City of Toledo has previously engaged in the design of a replacement Raw Water Main to update one of the existing aging Raw Water Main that was installed in 1940 and is reaching the end of its useful life. The replacement of the Raw Water Main is critical to ensure a continued reliable water supply to the Toledo region.
As a part of the installation process, the construction of the new Raw Water Main will damage and disrupt the existing farm tile subsurface drainage systems on the agricultural lands that the project traverses. As a condition of both the historical and contemporary easement agreements, the City is to restore damage field tile or compensate landowners to restore or relocate damaged field tile.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $1,500,000 is authorized from the Water Replacement Fund Account 6063-32000-4UC3526STDSTD and the expenditure of the same is authorized for the Raw Water Main Tile Restoration Project.
SECTION 2. That the Mayor is authorized to accept bids and execute the necessary contract(s) or agreements, Raw Water Main Tile Restoration Project upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 3. That the Finance Director is authorized to issue their warrant or warrants against the Account Code listed in Section 1 in an amount not to exceed $1,500,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 4. That the disappropriation of any remaining budget to fund balance at project closeout is authorized.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be effective immediately in order to maintain the supply of potable water to the region in an efficient manner.
