Authorizing the appropriation and expenditure in an amount not to exceed $435,000 from the unappropriated balance of the Sanitary Sewer Replacement Fund for Construction Management, Project Inspection and Professional Services for the Renovation of the Chemical Treatment Facilities at the Bay View Water Reclamation Plant; authorizing the Mayor to enter into an amended professional and engineering services agreement with Kleinfelder Inc., formerly known as Poggemeyer Design Group to provide additional professional and engineering services; waiving the competitive bidding provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
The Division of Water Reclamation (Division) contracted with Kleinfelder Inc. in 2020 to design and manage the construction of the Chemical System Renovations Project (Project) at the Bay View Water Reclamation Plant. Ordinance Nos. 586-19 and 106-23 provided funding for the design of the Project. Kleinfelder Inc. through coordination with Division staff has completed the design phase and is in the process of bidding the construction phase of the Project. The Division is looking to amend the professional and engineering services agreement with Kleinfelder Inc. to provide Construction Management, Project Inspection and Professional Services, as deemed necessary, during the construction phase of the Project. This Ordinance will provide additional funding in an amount not to exceed $435,000 to cover additional engineering services during the construction phase.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of an amount not to exceed $435,000 is authorized from the unappropriated balance of the Sanitary Sewer Replacement Fund to Account Code 6073-36000-4UC3224STDSTD and that the expenditure of the same amount is authorized for Construction Management, Project Inspection and Professional Services for the Chemical System Renovations Project at the Bay View Water Reclamation Plant.
SECTION 2. That the Mayor is authorized to enter into an amended professional and engineering services agreement with Kleinfelder Inc. for Construction Management, Project Inspection and Professional Services for the Chemical System Renovations Project at the Bay View Water Reclamation Plant, upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 3. That this Council finds and determines it is in the best interest of the City of Toledo to waive the competitive procurement provisions of TMC Chapter 187 for the reason that Kleinfelder Inc. was originally selected through a competitive bidding process and is best suited to continue to provide professional and engineering services during the construction phase of the Chemical System Renovations Project at the Bay View Water Reclamation Plant. Rates for the additional engineering services are consistent with rates in the original contract and with rates for contracts at the division providing similar professional services.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the account code identified in Section 1 in an amount not to exceed $435,000 in payment of the obligations authorized herein upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to provide Construction Management, Project Inspection and Professional Services, as deemed necessary, during the construction phase of the Chemical System Renovations Project at the Bay View Water Reclamation Plant.
