Title
Authorizing the Mayor to enter into a one (1) year agreement with Buckeye Pumps for the purpose of providing repair service for the Spentlime Dewater Facility pre-fill tank mixer; authorizing the expenditure from the Water Operating Fund in an amount not to exceed $32,000; waiving the competitive bidding provisions of TMC Chapter 187; and declaring an emergency.
Body
SUMMARY & BACKGROUND:
The project takes place at the City of Toledo's Spentlime Dewatering Facility, where spentlime is processed into a reusable solid form. The facility operates two presses, handling approximately 250,000 gallons of spentlime per day. The spentlime entering the presses has a solid content of 4-5%, which increases to 45-50% after processing. A mixer is used to keep solids suspended; if the mixer malfunctions, the solids content drops to about 3-4% before pressing. Higher solid content going into the presses results in a higher percentage of solids coming out. Currently, only one mixer is in operation, and there is no functional spare available if it fails.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a one (1) year agreement with Buckeye Pumps for the purpose of repair services for the Spentlime Dewater Facility pre-fill tank mixer, located at the Collins Park Water Treatment Plant, upon terms and conditions acceptable to the Department of Public Utilities and the Director of Law.
SECTION 2. That the expenditure of an amount not to exceed $32,000 is authorized from the Water Operating Fund, Account Code 6060-32000-4000505STDSTD for the purposes authorized in Section 1.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding provisions of TMC Chapter 187 for the reason that Buckeye Pumps is the sole distributor and repair service in Northern Ohio for the current spentlime dewatering presses and is therefore best suited to continue maintaining the spentlime dewatering mixers.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $32,000 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be effective immediately in order to continue to efficiently remove spentlime at the Collins Park Water Treatment Plant.
