Authorizing the Mayor to enter into a software subscription agreement for the purposes of contract and prevailing wage compliance for a term of one (1) year with options for four (4) one-year renewals; authorizing the General Fund expenditure in an amount not to exceed $110,000 per year subject to annual appropriation; and declaring an emergency.

SUMMARY & BACKGROUND:

The City of Toledo regularly enters into contracts for the operation of government business. To efficiently monitor compliance with local, state and Federal Prevailing Wage (PW) guidelines and any Minority Business Enterprise and/or Woman Business Enterprise (M/WBE) goals the software will organize PW and contract compliance processes including, but not limited to:

 

                     Track and report spend across prevailing wage contracts and subcontracts as it pertains to certified business entities (M/WBEs and Small Business Enterprises (SBEs))

                     Collect and analyze Certified Payroll Reports for payment and classification accuracy;

                     Collect Prompt Payment documentation;

                     Manage the Prevailing Wage compliance process;

                     Manage the Section 3 compliance process; and

                     Compile data on City Contracting.

 

Through the competitive bidding process, SkillSmart, Inc. has been identified as the lowest and best bidder. This Ordinance authorizes entering into a 1-year agreement with the option to renew for an additional four (4) one-year terms in an amount not to exceed $110,000 per year.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to enter into a software subscription agreement for the purposes of contract and prevailing wage compliance for a term of one (1) year with options for four (4) one-year renewals upon such terms and conditions as the Mayor may deem requisite and proper and subject to approval by the Department of Law and the Director of Diversity, Equity and Inclusion.

 

                      SECTION 2. That, subject to appropriation, the expenditure of an amount not to exceed $110,000 annually is authorized from the General Fund, Account Code 1001-10700-1121003STDSTD for the purposes authorized in Section 1.

 

                     SECTION 3. That the Director of Finance is authorized to draw a warrant or warrants against the above Account Code in an amount not to exceed $110,000 annually in payment of the above authorized obligations upon presentation of the proper voucher(s).

 

                     SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason of increasing efficiencies and avoiding delays in the administration of contracts for the operation of the City of Toledo.

 

Vote on emergency clause:  yeas 12, nays 0.
