Title

Authorizing the annual expenditure of an amount not to exceed $250,000 from the General Fund for necessary Tenant’s Right to Counsel in Eviction Proceedings services related to Toledo Municipal Code Chapter 1768; and declaring an emergency.

SUMMARY & BACKGROUND:

The purpose of this ordinance is to make funding available to expend for Legal Aid of Western Ohio to provide Tenants’ Right to Counsel in Eviction Proceedings services as outlined in Ordinance 418-21. 

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That subject to annual appropriation the expenditure of $250,000 annually is authorized from the General Fund Account Code 1001-16200-5129003TENRIG for Tenants’ Right to Counsel in Eviction Proceedings pursuant to the existing agreement with Legal Aid of Western Ohio for said services over the remaining four years of the term.

 

                     SECTION 2. That the Director of Finance is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $250,000 annually for the above-authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 3.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to timely expend these funds for Tenant Landlord Services duties.
