SUMMARY & BACKGROUND:

It was determined additional street lights along Rosedale Avenue bounded by Freeman Street and Macomber Street, Cone Street bounded by Rosedale Avenue and Auburn Avenue, Freeman Street bounded by Macomber Street and Bancroft Street and lighting in the alleys bounded Cone Street and Milburn Avenue, Milburn Avenue and Macomber Street, Macomber Street and Freeman Street were necessary to improve the lighting conditions for pedestrian and street traffic safety. There will be an addition of 10 50-watt light emitting diode (LED) lights. The total annual cost for the operation and maintenance of the lighting is operation and maintenance costs of the lighting is $2,658.10 of which the city’s share is $185.72.  Additionally, O-393-23 and O-271-24 authorize the cost of $7,000 to be paid for installation from the Local Fiscal Recovery Fund.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That it is determined to proceed with the improvement of the following lots and lands by installing street lighting, as described below, pursuant to the authority cited below and in accordance with Resolution No 456-24, adopted on September 25, 2024, and in accordance with plans, specifications, and estimates heretofore approved and on file with the Clerk of Council and in the Department of Public Service.

 

A.                     Rosedale Avenue bounded by Freeman Street and Macomber Street, Cone Street bounded by Rosedale Avenue and Auburn Avenue, Freeman Street bounded by Macomber Street and Bancroft Street, installation of 4 new 50-watt light emitting diode (LED) lights.

 

B.                     There will be an addition of 6 50-watt light emitting diode (LED) lights installed along the alleys bounded by Woodland Avenue and Pinewood Avenue, Avondale Avenue and Belmont Avenue, Belmont Avenue and Vance Street were necessary to improve the lighting conditions for pedestrian and street traffic safety.

 

                     SECTION 2.                     That the expenditure of  7,000 is authorized from the from the Local Fiscal Recovery Fund Account Code 2021-27100-2STREETLTSNEI for the improvements to the LED lighting at the location listed in Section 1.

 

                     SECTION 3.                     The following lots and lands are determined to be specifically benefitted by said improvement and each shall be assessed at the estimated rate per assessed front foot indicated, representing that part of the cost of lighting said streets as above described:

 

A.                                          All lots and lands bounding and abutting the section of  Rosedale Avenue bounded by Freeman Street and Macomber Street, Cone Street bounded by Rosedale Avenue and Auburn Avenue, Freeman Street bounded by Macomber Street and Bancroft Street are assessed at the rate of ($1.198) per assessed front foot.

B.                     Alleys bounded by Woodland Avenue and Pinewood Avenue, Avondale Avenue and Belmont Avenue, Belmont Avenue and Vance Street, are assessed at the rate of ($0.394) per assessed front foot.

 

                     SECTION 4.                      That the estimated annual cost for the operation and maintenance of the lighting is $2,658.10 of which the city’s share is $185.72                       

 

                     SECTION 5.                     That the costs related to the improvement shall be levied and assessed annually in accordance with the Assessing Ordinance hereafter to be passed by City Council, and said assessments shall be certified to the County Auditor to be placed upon the tax duplicate and collected as other taxes.

 

                     SECTION 6.                     That the remainder of the cost and expense of said improvement not specially assessed together with damages, if any, awarded to the owner or owners of adjoining lands with interest thereon, and the costs and expenses of any such award shall be paid by a levy upon the general tax list made by the city for such purpose in the manner provided by law.

 

                     SECTION 7.                     That the Toledo Edison Company is authorized and directed to accomplish the improvements described in Section 1 hereof; such lights to be erected and maintained, and payment therefore to be made in accordance with the applicable terms and provisions of the Toledo Edison street lighting tariff as approved by the Public Utilities Commission of Ohio.

 

                     SECTION 8.                     That the Clerk of Council is directed to furnish Toledo Edison Company with a certified copy and written notice of the passage of the Ordinance after publication of the same.

 

                     SECTION 9.                     That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to expedite the installation of street lighting.
