Body

SUMMARY & BACKGROUND:

The administration is examining the status of all boards and commissions listed in the Toledo Municipal Code. In an effort to unify all working boards and commissions and to promote greater efficiencies, the Administration is seeking to consolidate the current Board of Community Relations, Affirmative Action, and the Youth Commission into one new single Board to be comprised of citizens representing various specific interests. This new board will serve the Administration in an advisory capacity and will promote amicable youth and community relations through positive measures and enhance favorable interracial and intercultural relationships in the City.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That Toledo Municipal Code Chapter 159 "Board of Community Relations and Affirmative Action" which states:

 

159.01. Creation; membership; term.

   (a)   Creation. A Board of Council is hereby created, titled Board of Community Relations (hereinafter called the Board), to consist of no more than twenty-six members, appointed by the Mayor and subject to confirmation by Council, as follows:

      (1)   Sixteen members nominated by community groups as specified in subsection (b) hereof;

      (2)   Eight members directly appointed by the Mayor, subject to confirmation by Council; and

      (3)   Two youth members nominated by the Board from candidates submitted to it.

   (b)   Membership.

      (1)   Three members of the Board shall be nominated on behalf of the business community by an ad hoc committee consisting of representatives duly appointed by the Chamber of Commerce.

      (2)   Three members of the Board shall be nominated on behalf of the education community by an ad hoc committee consisting of representatives duly appointed by the Toledo Public Schools, Washington Local Schools, Catholic School Services, the Toledo Federation of Teachers and the Toledo Association of Administrative Personnel.

      (3)   One member of the Board shall be nominated by a nominating committee of duly appointed representatives of the University of Toledo.

      (4)   Three members of the Board shall be nominated on behalf of the religious community by an ad hoc committee consisting of duly appointed representatives of the Baptist Ministers Conference, the Interdenominational Ministerial Alliance, the Interracial Religious Coalition, Metro Toledo Churches United and Toledo Metropolitan Mission.

      (5)   Three members of the Board shall be nominated on behalf of the labor community by a nominating committee of the United labor Committee.

      (6)   Three members of the Board shall be nominated on behalf of neighborhood organizations by an ad hoc committee consisting of representatives duly appointed by community development corporations as defined by those nonprofit organizations in the City of Toledo receiving Community Development Block Grant funds for housing or planning activities. Thereafter, subsequent appointees shall be selected by a procedure established by the Board within twelve months from the date of the enactment of this chapter.

      (7)   The nominations of persons as provided for in this subsection shall be in effect upon receipt by the Mayor of a written communication which names the person(s) being appointed and the term of the appointment and which is signed by the appropriate community group ad hoc or nominating committee members. Upon the Mayor's acceptance of the nomination, the Mayor shall forthwith file the same with the Clerk of Council. In the event that a nominee is not accepted, the appropriate ad hoc or nominating committee will be requested to provide another nomination. In the event that a nomination is not received by the Mayor on or prior to the thirtieth day of the term of Board membership, the Mayor shall proceed to appoint, subject to confirmation by Council, a person to serve such term.

      (8)   During a term, any vacancy on the Board, occasioned by resignation, death, disability or other cause as defined in the Board's by-laws, shall be filled for the remainder of the term, by a person selected in the same manner as the person being replaced. In the event that the Mayor does not receive a communication which names the person to fill the vacancy within thirty days after the occurrence of such a vacancy, the Mayor shall proceed to appoint, subject to confirmation by Council, a person to serve such term.

      (9)   It is Council's wish that the Board be comprised of members who represent the racial and ethnic diversity of the men and women of Toledo, and who have demonstrated in their words and actions a sensitivity to the need to end discrimination and insure equal opportunity for all.

      (10)   At least once every five years, the Board shall review the continued appropriateness of the organizations included in the appointment process and the racial and gender representation of the Board in order to improve the selection process and enhance the Board's actual and perceived representation of the community, and shall report to Council its recommendations regarding any changes in the provisions of its recommendations regarding any changes in the provisions of this section.

   (c)   Terms.

      (1)   Of the three original members selected on behalf of the business, education, religious, neighborhood organizations and labor communities, respectively, one shall serve for a term of one year, one for a term of two years and one for a term of three years. Thereafter, each of such appointees shall serve for a term of three years.

      (2)   The member selected on behalf of the University of Toledo shall serve for a term of three years.

      (3)   Of the eight original members directly appointed by the Mayor, three shall serve for a term of one year, three for a term of two years and two for a term of three years. Thereafter, each of such appointees shall serve for a term of three years.

      (4)   One of the two youth members selected on behalf of the youth population shall serve for a term of two years, and one shall serve for a term of one year.

159.02. Duties and powers; meetings and by-laws.

   (a)   The duties and powers of the Board shall be to:

      (1)   Promote amicable relations through positive measures to ensure and enhance favorable interacial and intercultural relationships in the City;

      (2)   Take appropriate steps to eliminate conditions which strain racial and cultural relationships;

      (3)   Aid in the coordination of the activities of public and private organizations concerned with improving interracial and intercultural relationships;

      (4)   Aid in the coordination of activities of public and private organizations concerned with eliminating discrimination based on race, religious creed, color, national origin, ethnic origin, ancestry, gender, handicap, age or sexual orientation;

      (5)   Encourage and enhance equal opportunity in employment, freedom of choice in housing, and full and fair economic opportunity for all citizens;

      (6)   Receive, investigate, seek to mediate, or refer to the appropriate agency, serious and legitimate complaints of discriminatory behavior based on race, religious creed, color, national origin, ethnic origin, ancestry, gender, handicap, age or sexual orientation;

      (7)   Receive, investigate, seek to mediate or refer to the appropriate agency (including but not limited to the Fair Housing Center, Housing Directions and the Ohio Civil Rights Commission), all legitimate complaints of discrimination in employment or housing as prohibited by Chapter 554;

      (8)   Develop and coordinate programs throughout the Toledo area school systems which will promote an understanding by all students and staff of the need for good racial, religious and ethnic relations;

      (9)   Make investigations and studies and provide information relating to racial and cultural relationships to Council and other interested parties;

      (10)   Attract and receive tax deductible grants, gifts and donations and expend such resources to further the purposes of the Board;

      (11)   Recommend to the Mayor a candidate for appointment to the Office of Executive Director of the Board and review the Executive Director's performance;

      (12)   At least annually, and whenever so requested by Council, report its activities to Council;

      (13)   The Board shall not involve itself in any investigations outside of Lucas County, nor engage in contracts with communities outside Lucas County for a twenty-four month period from the effective date of this section; and

      (14)   Monitor the activities of the economic development agencies within municipal government and report such results to Council.

   (b)   Meetings and by-laws.

   The Board shall meet, select an executive body and adopt by majority vote such rules, by-laws and procedures as shall be expedient for the conduct of its business.

159.03. Executive Director; other employees.

   (a)   The position of Executive Director of the Board of Community Relations and Affirmative Action is hereby created and appointment to such position shall be made by the Mayor on the recommendation of the Board. Such Executive Director shall serve until removed by the Mayor on the concurrence of the majority of the Board.

   (b)   Such clerical and other employees of the Board, as Council shall approve, shall be appointed by the Mayor in accordance with the provisions of the City Charter.

   (c)   The salary of the Executive Director and other employees of the Board shall be fixed by Council.

159.04. Duties of Executive Director.

   Under the direction of the Board, the Executive Director shall be administratively responsible for the staff. The Executive Director shall:

   (a)   Further the purposes of the Board and report such progress to the Board; and

   (b)   Implement the decisions, directives and recommendations of the Board.

159.05. Office space.

   The Mayor shall assign to the Board of Community Relations and Affirmative Action adequate office space and facilities for the fulfillment of its duties.

159.06. Expenses.

   The expenses of the aforesaid Board shall be met by such appropriations as are made by Council for such purpose.

159.07. Discrimination complaints; investigation.

   (a)   Any person who believes that he or she is a victim of any discriminatory practice prohibited in Chapter 554 may submit a written complaint to the Board for its assistance in mediating, investigating or making a proper referral.

   (b)   All such complaints shall be properly verified by the person alleging discrimination and filed with the Board within 120 days after the alleged discriminatory act is committed.

   (c)   The Board shall attempt to mediate, investigate or refer to the appropriate agency all complaints arising under Chapter 554.

   (d)   The Board shall submit to the City Law Department all finalized investigatory reports in which a finding of probable cause to believe that discrimination had occurred by the acts of any employee of a City department, division or commission.

159.08. Legal counsel.

   The Board shall have the authority to retain or consult independent legal counsel, aside from the City Law Department, whenever:

   (a)   The City or any of its officers or agencies is a respondent before the Board, is in an adversarial relationship with the Board or a complainant before the Board; and

   (b)   The Board has received written authorization for retention of outside legal counsel from the Mayor and sufficient funds have been budgeted by the Board for such expenditures.

   The Board's expenditure of funds for independent legal counsel shall be subject to Section 228 of the City Charter.

159.09. Subpoena power.

   (a)   As a committee of Council solely for this purpose, the Board shall have the power to subpoena witnesses, compel their attendance, administer oaths, take sworn testimony and, in connection therewith, to require the production for examination of any documents relating to any matter under investigation or properly in question before the Board. Such subpoena shall be signed by the chairperson of the Board. No such subpoena however shall be issued without an affirmative vote of approval of not less than two-thirds of the total membership of the Board. Should any person refuse to testify or produce such documents after receipt of such subpoena, Council shall have the power to cause the witness to be punished as for contempt.

   (b)   Any City official or agency requested to provide documents or records to the Board shall do so immediately, without the necessity for the issuance of a subpoena.

159.10. Budget of the Board.

   The Board shall make its annual budget request and any supplemental requests through the office of the Mayor in conjunction with the annual budget for the City of Toledo.

                      SECTION 2. That Toledo Municipal Code Chapter 184 "Toledo Youth Commission which states: 

184.01. Creation; purpose.

   (a)   The Toledo Youth Commission is hereby created and authorized to promulgate and further the policies of the Mayor and Council pertaining to the youth within the City.

   (b)   The Toledo Youth Commission shall endeavor to promote and facilitate, in the City, and environment that nurtures and enhances the development of youth which may assist youth to reach their full potential as well as enable them to function in a multicultural society.

184.02. Membership; terms.

   (a)   The Toledo Youth Commission shall be comprised of thirteen adult members, representative of the community, who are deemed to be youth sensitive and oriented, and nine youth members.

   (b)   The members of the Commission shall be appointed by the Mayor subject to confirmation by Council.  The adult Commission members shall serve a three-year term on the Commission.  The nine youth members comprised of sophomore status and higher, will serve a calendar school-year term.

   (c)   The racial and gender make-up of the adult Commission members shall be balanced and representative of the Toledo community.  One of the thirteen adult members shall be representative of the Toledo Public Schools, one shall be a representative of other schools, one shall be a health and wellness representative, one shall be a recreation representative, one shall be a workforce development representative, one shall be a mental health representative, and one shall be a civic engagement representative.

   (d)   Of the nine youth members, at least three shall be male and three shall be female.  Six of the members shall represent their respective City Council District of the City, hereinafter "District".

   (e)   Each District youth member shall be required to convene an advisory panel in their district, hereinafter referred to as "District Youth Panel," a minimum of once yearly and report back to the Youth Advisory Committee.  The District Youth Panel should be comprised of other youth from the district and shall be supported by the District Councilperson, Youth Commission Director, and other Youth Commission members as needed.

184.03. Director; appointment; removal.

   The position of Youth Commission - Director is hereby created and appointment to the position shall be made by the Mayor, upon the recommendation of the Commission, subject to approval by Council.  The Youth Commission - Director shall serve until removed by the Mayor on the recommendation by a majority of the Commission members.

184.04. Other employees; office space and expenses.

   Clerical and other employees of the Commission, as Council shall approve, shall be appointed in accordance with the provisions of the City Charter and civil service.

184.05. Duties and powers; meetings and by-laws.

   (a)   The duties and powers of the Commission shall be to:

      (1)   Provide direction, objectives and priorities for the Youth Commission Director.

      (2)   Director and all Board members should contribute to an agreed upon community youth development framework.

      (3)   Foster, advocate and promote partnerships with and between the public and private sectors that will further an impact on youth as it pertains to learning, working, thriving, connecting, and leading.

      (4)   Through review and assessment, align programs in our community to meet the needs for City youth.

      (5)   Create the Youth Advisory Committee, made up of the nine Youth Commission District members, inclusive of its by-laws and provisions to assure adequate gender and racial representation of City youth.  The Youth Advisory Committee shall report to the Youth Commission at each regularly scheduled meeting.

      (6)   Develop measurable goals and accomplishments of the Commission to the Mayor and members of Council on an annual basis or as otherwise requested by Council.

      (7)   Report the goals and accomplishments of the Commission to the Mayor and members of Council on an annual basis or as otherwise requested by Council.

   (b)   The Commission shall meet, select an executive body and adopt by majority vote such rules, by-laws and procedures as shall be expedient for the conduct of business.

184.06. Duties of the Director.

   The following are duties of the Youth Commission Director:

   (a)   Along with the Youth Commission Board and district leaders, develop and recommend to the Commission long and short range plans for initiatives which foster cooperative efforts among community youth agencies.

   (b)   Executes and implements the plans and programs enacted or adopted by the Commission.

   (c)   Executes and implements the directives and decisions of the Commission.

   (d)   Executes and implements the mission statement of the Commission as delineated by the Commission.

   (e)   Develops and promotes work with community agencies, area youth planning and coordinating bodies, public and private funders to develop, create, and promote a comprehensive youth development strategy.

   (f)   Accumulates, interprets and disseminates trends, studies and reports in the youth service field for and to the Commission.

   (g)   Maintains an up-to-date database of information on youth service providers, as well as develops knowledge and builds relationships with said providers.

   (h)   Prepares the Commission budget, participates in fund raising activities with a focus on applying for youth-service related grants and provides overall leadership in the fiscal aspects of the Commission.

   (i)   Performs other duties, as deemed appropriate by the Commission, regarding the planning, organizing, directing and coordinating of various functions, activities and responsibilities associated with the areas of youth.

   (j)   Support each of the nine District youth members to convene the District Youth Panel in each district twice yearly to help facilitate district level planning and prioritization of youth needs and goals, foster active participation of "Youth Advisory Committee" and shall attend all meetings of said committee.

184.07. Acceptance of donations.

   (a)   The Youth Commission for the City of Toledo is hereby authorized to solicit and accept funds for the purpose of supporting non-profit activities having to do with youth programs and activities within the City of Toledo.

   (b)   Any funds relieved shall be deposited in the Youth Commission Trust, Account No. 90-6020-5639-T72702, which is hereby established to serve as a depository for all funds received.

SECTION 3.  That a new Toledo Municipal Code Chapter 159 "Human Relations Commission" is enacted which states as follows:

CHAPTER 159
Human Relations Commission

159.01     Creation; purpose.

(a)                     Creation. The Human Relations Commission is hereby created and authorized to promulgate and further the policies of the Mayor and Council pertaining to the community and youth within the City.

(b)                     The Human Relations Commission shall endeavor to support a safe, energetic, and livable city. The Commission will support residents working to overcome prejudice and build mutual respect.

159.02     Membership; terms.

(a)                                          Membership. The Commission shall consist of no more than 10 members, appointed by the Mayor and subject to confirmation by Council.  Initially the composition of the Commission will include three members appointed to one year terms, three members appointed to two year terms and four members will be appointed to three year terms.   Members appointed after the initial members are appointed shall be appointed for three year terms.

(b)                     The Commission will annually elect 5 members to serve as an Executive Committee.  The Executive Committee shall be compensated at the same rates as member to the City of Toledo Civil Service Commission and sufficient sums shall be appropriated each year for the purpose of compensation.

(c)                                          During a term, any vacancy on the Commission, occasioned by resignation, death, disability or other cause as defined in the Commission’s by-laws, shall be filled for the remainder of the term, by a person selected in the same manner as the person being replaced.

(d)                     To the greatest extent practicable the Commission be comprised of members who represent the racial and ethnic diversity of the men and women of Toledo, and who have demonstrated in their words and actions a sensitivity to the need to end discrimination and insure equal opportunity for all.

 

159.03     Duties and powers; meetings and bylaws.

(a)                     The duties and powers of the Commission shall include:

 

(1)                     Overseeing the Welcome TLC initiative.

 

(2)                     Overseeing initiatives to reduce violence.

 

(3)                     Supporting efforts to build tolerance and diversity in areas of race, gender, religion, ability, sexual orientation and gender identity.

 

(4)                     Coordinating resident mediations on issues outside of the jurisdiction of the Toledo Municipal Court.

 

(5)                     Supporting social justice trainings.

 

(6)                     Developing measurable goals and accomplishments of the Board to the Mayor and members of Council on an annual basis or as otherwise requested by Council.

(7)                     Fostering, advocating and promoting partnerships with and between the public and private sectors that will further an impact on youth as it pertains to learning, working, thriving, connecting, and leading.

(8)                     Thoroughly reviewing, assessing, and aligning programs in the community to meet the needs for City youth

(9)                     Reporting the goals and accomplishments of the Commission to the Mayor and members of Council on an annual basis or as otherwise requested by Council.

(b)                     The Commission shall meet, select an executive body and adopt by majority vote such rules, by-laws and procedures as shall be expedient for the conduct of business.

(c)                     The Executive Committee will serve as mediators and will oversee all resident mediations. Mediations will be held at least once a month.  Outcomes from the mediations will be reported back to the full Human Relations Board at the following Board meeting.

159.05. Subpoena power.

Such subpoena shall be signed by an Executive Committee Member. No such subpoena however shall be issued without an affirmative vote of approval of not less than two-thirds of the total membership of the Commission. Should any person refuse to testify or produce such documents after receipt of such subpoena, the Law Director shall seek to enforce the subpoena in the Court of Common Pleas.

   (b)   Any City official or agency requested to provide documents or records to the Commission shall do so immediately, without the necessity for the issuance of a subpoena.

 

159.06     Budget, acceptance of donations.

   (a)   The Human Relations Commission for the City of Toledo is hereby authorized to solicit and accept funds for the purpose of supporting non-profit activities having to do with community youth programs and activities within the City of Toledo.

   (b)   Any funds received from donations shall be deposited in the Human Relations Commission Trust Account, 2150-10600-1T72704STDSTD, which is hereby established to serve as a depository for all funds received and said amounts shall be deemed appropriated for proper expenditure. The Commission shall be authorized to expend monies from the Human Relations Commission Trust Account 2150-10600-1T72704STDSTD for purposes consistent with the mission of the Commission subject to the provisions governing expenditure of funds set forth by law.

 

Section 4. That Toledo Municipal Code Section 168.02 which states:

 

168.02. Duties; powers.

   The duties and powers of the Latino Affairs Commission shall be to:

   (a)   Advise the Mayor and Toledo City Council regarding all aspects of Latinos in Toledo, including the barriers that impede, as well as opportunities, policies and programs available or necessary to spur the advancement of the Latino community as it pertains to employment, education and economic development in the Toledo area.

   (b)   Compile and disseminate statistics, demographics, studies and reports regarding the Toledo Latino community in the area of employment, education, and economic development.

   (c)   Provide assistance and advice to all City departments, divisions and agencies, but specifically to the Board of Community Relations, Office of Diversity and Inclusion and the Department of Human Resources in pursuit of their respective goals and objectives as it pertains to Latinos in Toledo.

   (d)   Organize, develop, promote and sponsor activities and programs to realize the purpose and objectives of this chapter.

   (e)   Serve as liaison, advocate and clearinghouse between the Toledo Latino community, the Mayor, and Toledo City Council.

SECTION 5.  That a new Toledo Municipal Code Section 168.02 is hereby enacted that states as follows:

 

168.02. Duties; powers.

SECTION 6.  That Toledo Municipal Code Section 2101.01 which states as follows:

 

2101.01  Classifications.

   The employees working in classifications listed in this section comprise the Exempt Service and are the management level, supervisory and confidential staff of the Mayor's Office, the Word Processing Section, the Department of Law, the Clerk of Council Office, the Department of Human Resources, the Financial Analysis Section and other City Divisions.

   Employees working in these classifications are excluded from representation by any bargaining agent.

   The management level, supervisory and confidential classifications presently included in the exempt group are as follows:

   (a)   Administrative Salary Groups 1 through 15 (A-1 through A-15)

SECTION 7. That a new Section 2101.01 is enacted to state as follows:

2101.01  Classifications.

   The employees working in classifications listed in this section comprise the Exempt Service and are the management level, supervisory and confidential staff of the Mayor's Office, the Word Processing Section, the Department of Law, the Clerk of Council Office, the Department of Human Resources, the Financial Analysis Section and other City Divisions.

 

   Employees working in these classifications are excluded from representation by any bargaining agent.

 

   The management level, supervisory and confidential classifications presently included in the exempt group are as follows:

SECTION 8. That the Youth Commission Trust, Account Code 2090-6020-5639-T72702, is disestablished and any amounts in the Youth Commission Trust shall be transferred to the Human Relations Commission Trust Account Code 2150-10600-1T72704STDSTD.

 

SECTION 9.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide improved coordination and planning for the City’s youth and community programs.
