SUMMARY & BACKGROUND:
Toledo City Council passed Ord. 209-73 amending the Toledo Municipal Code originally enacted in 1952 as Code Section 3-2-6. This Ordinance repeals and replaces Toledo Municipal Code Chapter 141, Section 141.01. The amendment maintains the original term limits with an update to the code providing for an annual review of boards and commissions to determine whether they have become inactive over a specific period. The amendment also establishes a process to remove those inactive boards and commissions.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That Toledo Municipal Code Chapter 141 "General Provisions;" Section 141.01 "Appointments to boards and commissions; limitation of terms;" which currently reads:
141.01. Appointments to boards and commissions; limitation of terms.
Those persons hereafter appointed excepting elected officials, officers and employees of the City, who serve ten consecutive years as a member of a board or commission shall not be eligible for reappointment to the same board or commission until expiration of a period equivalent to a full term on such board or commission, provided, however, they shall be permitted to complete the term for which they were last appointed.

SECTION 2. That a new Toledo Municipal Code Chapter 141 "General Provisions;" Section 141.01 "Appointments to boards and commissions; limitation of terms;" is enacted as follows:
141.01 Appointments to boards and commissions; limitation of terms; sunset provision for inactive boards and commissions.
(a) Term Limitation. Those persons hereafter appointed excepting elected officials, officers and employees of the City, who serve ten consecutive years as a member of a board or commission shall not be eligible for reappointment to the same board or commission until expiration of a period equivalent to a full term on such board or commission, provided, however, they shall be permitted to complete the term for which they were last appointed.
(b) Annual Review of Board and Commission Activity.
1. The Administration shall, on or before December 31st of each year, conduct a review of all boards and commissions established by Council ordinance or resolution to determine which boards and commissions have been inactive during the preceding calendar year.
2. For purposes of this section, a board or commission shall be deemed "inactive" in any calendar year in which the board or commission has failed to hold a meeting, conduct business, issue a report, or otherwise perform any function assigned to it by ordinance, resolution, or Council directive.
3. If determined during the annual review that any board or commission has been inactive for five consecutive calendar years, the Administration shall prepare and submit to Council a written recommendation identifying such board or commission and recommending its elimination.
4. The recommendation to Council shall include a reference by number to the original ordinance or resolution, a summary of the assigned functions and responsibilities, documentation that the board or commission has been inactive for five or more years and a statement that the board or commission is not required by the City Charter, the Ohio Revised Code or any federal law.
5. Upon receipt of the recommendation from the Administration, Council shall, within ninety (90) days, consider whether to remove the board or commission by ordinance or resolution, in the same manner that the board or commission was originally established and to amend the Toledo Municipal Code to reflect the removal of the board or commission.
SECTION 3. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property.
