SUMMARY & BACKGROUND:

The Division of Traffic Management is responsible for 492 traffic signals throughout the city.  These signals utilize software that could potentially be the target of cybersecurity threats, which if attacked, could result in damages to the safety and efficiency of traffic flow, and on a broader level, allow hackers access to network operations.

 

The division is working closely with the Information Technology Division to provide specialized cybersecurity testing including internal vulnerability assessment, internal and external penetration testing, and physical penetration testing.  They will also provide an evaluation of operational capabilities including governance, change management, business continuity management, incident response, and vulnerability management.

 

This legislation will allow for the disappropriation and reappropriation of funds within Traffic Management’s 2024 operating budget in order for IT to enter into contracts for these cybersecurity services.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the disappropriation of $35,000 is authorized from various supply accounts within the Street Construction Maintenance and Repair Fund (SCM&R) Account Code 2014-22500-2413001STDSTD. 

 

                     SECTION 2. That the disappropriation of $55,000 is authorized from various supply and service accounts within the Street Construction Maintenance and Repair Fund (SCM&R) Account Code 2014-22500-2413002STDSTD. 

 

                     SECTION 3.  That the appropriation of an amount not to exceed $90,000 is authorized to the Street Construction Maintenance and Repair Fund (SCM&R) Account Code 2014-22500-2413002STDSTD, and the full amount is authorized for expenditure for cybersecurity testing and evaluation.

 

                     SECTION 4. That the Mayor is authorized to enter into a contract for cybersecurity testing and evaluation services upon terms and conditions acceptable to the Director of Law, the Director of Information Technology, and the Director of Transportation.

 

                     SECTION 5. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding provision of TMC Chapter 187 for the reason that the waiver is necessary to preserve the integrity of the infrastructure security and the selected vendor’s services are cost-competitive.

 

                     SECTION 6.  That the Finance Director is authorized to draw their warrant or warrants against the above listed account code in an amount not to exceed $90,000 in payment of the obligations authorized above upon presentation of proper voucher or vouchers.

 

                     SECTION 7.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to provide the described services before the end of the fiscal year.
