SUMMARY & BACKGROUND:
The Division of Water Reclamation submitted Ordinance #302-22 for the rehabilitation of Final Tank 12. Ordinance #302-22 authorized the mayor to waive competitive bidding under TMC Chapter 187 and to enter into a contract with Evoqua Water Technologies LLC (Evoqua), the sole source provider of parts and equipment and associated repairs. Evoqua opted to only provide parts and equipment and no labor for the rehabilitation work. Parts and equipment are expected to be delivered in April 2024. This Ordinance will allow the Division to advertise for construction bids and to select a contractor to rehabilitate Final Tank 12. The rehabilitation work is necessary to place Final Tank 12 back into operation and to maintain compliance with the National Pollutant Discharge Elimination System (NPDES) discharge permit requirements, as set forth by the Ohio EPA.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $100,000 is authorized from the unappropriated balance of the Sewer Replacement Fund into Account Code 6073-36000-4UC0622STDSTD for labor and services necessary for the completion of the Final Tank 12 Rehabilitation Project at the Water Reclamation Plant.
SECTION 2. That the expenditure of an amount not to exceed $100,000 is authorized from the Sewer Replacement Fund Account Code 6073-36000-4UC0622STDSTD for the purpose described in Section 1.
SECTION 3. That the Mayor is authorized to accept bids and award contracts for the labor and services necessary for the completion of the Final Tank 12 Rehabilitation Project at the Water Reclamation Plant, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $100,000 in payment of the obligations authorized herein upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That the Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Water Reclamation Plant, and to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.
