SUMMARY & BACKGROUND:
The City of Toledo, Department of Public Service, Division of Solid Waste operates under both state and federal regulations related to landfill operations. Effectively capturing and managing landfill gas are key elements of the City’s municipal solid waste operations. Regular improvements to a Gas Collection and Control System (GCCS) are an essential part of maintaining compliance and mitigating emissions of potent greenhouse gases, including methane and carbon dioxide.
Observing and documenting the construction of GCCS components is Construction Quality Assurance (CQA). CQA requires specialized experience and expertise. CQA is not only a necessary engineering effort to ensure project quality, it is also required by regulations promulgated by the Ohio Environmental Protection Agency (OEPA). Contractor schedules and regulatory considerations can influence the extent of CQA on any given construction project. The Department of Public Service, Solid Waste Division requested CQA services from SCS Engineers for 2024-2025 GCCS construction activities. SCS Engineering has the specific project experience and the requisite specialty expertise to ensure the Solid Waste Division meets the appropriate construction quality objectives and OEPA regulatory requirements.
Summary
NOW THEREFORE
Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a professional services agreement with SCS Engineers for Construction Quality Assurance (CQA) services related to Gas Collection and Control System (GCCS) construction at the Hoffman Road Landfill, upon terms and conditions acceptable to the Director of Law and the Director of Public Service.
SECTION 2. That an amount not to exceed $12,100 is authorized for expenditure from the Solid Waste Trust Fund Account Code 2090-24500-6T232301STDSTD and Capital Improvement Fund Account Code 5040-24500-8CP2419LFGGCCS, for the purpose authorized in Section 1.
SECTION 3. That the Finance Director is authorized to issue warrant or warrants against the Account Codes listed in Section 2 upon presentation of properly approved voucher or vouchers in a total amount not to exceed $12,100.
SECTION 4. That this Council finds and determines it is in the best interest of the city to waive competitive procurement requirements of TMC Section 187 for GCCS CQA at Hoffman Road Landfill. SCS Engineering has the specific project experience and the requisite specialty expertise to ensure the Solid Waste Division meets the appropriate construction quality objectives and OEPA regulatory requirements.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to timely meet the OEPA regulatory requirements.
