Authorizing the mayor to enter into a grant agreement with the Great Lakes Commission, in coordination with the National Oceanic and Atmospheric Administration and to accept and deposit grant proceeds into the Operation Grant Fund in an amount not to exceed $992,448 to fund the construction and implementation phase of the Restoration of the Ottawa River in Jermain Park Project; authorizing the appropriation and expenditure of said grant proceeds; authorizing the Mayor to execute necessary agreements in connection with the grant; authorizing the Mayor to accept bids and execute necessary contracts to administer the grant; and declaring an emergency.

SUMMARY & BACKGROUND:
Ordinances 256-22 and 215-23 previously authorized the acceptance of Great Lakes Commission Grant Number GLC-3871, which funded the engineering and design phase of the Restoration of the Ottawa River in Jermain Park Project. The City of Toledo has now been awarded funding and invited to enter into a new subrecipient agreement with the Great Lakes Commission for the construction and implementation phase. This Project is being initiated with funding from the U.S. Department of Commerce - National Oceanic and Atmospheric Administration through its Cooperative Agreement with the Commission U.S. Department of Commerce Award #NA23NMF4630030, entitled “Regional Partnership to Restore Fish Habitat in Great Lakes Areas of Concern. No match is required for the additional funds.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a grant agreement with the Great Lakes Commission, in coordination with the National Oceanic and Atmospheric Administration for the Restoration of the Ottawa River in Jermain Park Project upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds into the Operation Grants Fund, Account Code 2016-38000-6G02025STDSTD, in an amount not to exceed $992,448 from the Great Lakes Commission for the purpose of completing work necessary to administer the grant.
SECTION 3. That the appropriation from the unappropriated grant proceeds in an amount not to exceed $992,448 is authorized from the Operation Grants Fund into Account Code 2016-38000-6G02025STDSTD and further authorizing the expenditure of same for the Restoration of the Ottawa River in Jermain Park Project.
SECTION 4. That the Mayor is authorized to accept bids and execute necessary contracts related to this grant upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 5. That the Director of Finance is authorized to issue their warrant or warrants against the account code above in amounts not to exceed $992,448 in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this Ordinance must be immediately effective in order to implement this program within the Great Lake Commission’s designated time schedule.
