Summary
SUMMARY & BACKGROUND:
Ohio law allows property owners to assess themselves to fund a number of services through the creation of a Special Improvement District (SID). Passage of this legislation represents the first step of a process by which businesses downtown may agree to improved services to be paid for by a special assessment. The Ohio Revised Code (§§1710 et seq) requires that the legislative body of a community in which the proposed SID act on a petition within 60 days of the submission of such petition. A SID was established in downtown Toledo by approval of City Council in 2005. As a part of the City of Toledo’s ongoing efforts to more effectively coordinate the work of downtown entities and to more efficiently partner with downtown businesses to help maintain, improve, and build the downtown area of the City of Toledo as a viable business, cultural, residential, and recreational community, Council approval for a SID plan and budget for a successor five-year period commencing January 1st 2026 has been requested by Downtown Toledo Improvement, Inc. After securing by petition, the agreement of property owners representing at least 60% of the frontage of lots and lands to be assessed by this proposed SID, a petition for the establishment of a revised SID was filed by Downtown Toledo Improvement District, Inc. in conformance with the Ohio Revised Code (§§1710 et seq).
On May 30, 2025, DTID submitted a Petition, Amended Articles of Incorporation and Downtown Services Plan and Budget for consideration by City Council and the Mayor.
NOW THEREFORE, Be it resolved that:
SECTION 1. That the City of Toledo approves the petition submitted to Toledo City Council on May 30, 2025 for the establishment of a proposed Special Improvement District (SID) in downtown Toledo in the area identified in the attached maps. The name of the special improvement district created by Downtown Toledo Improvement District, Inc. shall be the “Downtown Toledo Improvement District” (“District”).
SECTION 2. That the City of Toledo also approves the Amended Articles of Incorporation of the Downtown Toledo Improvement District submitted to Toledo City Council on May 30, 2025 included with said Petition.
SECTION 3. That the City of Toledo also approves the Downtown Services Plan and Budget for the Downtown Toledo Improvement District submitted to Toledo City Council on May 30, 2025 included with said Petition and finds that the public services and improvements of said Plan will benefit the District.
SECTION 4. That this Resolution is declared to be an emergency measure and shall be in force and effect from and after its adoption. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective in order to maintain, improve, and build the downtown area of the City of Toledo as a viable business, cultural, residential, and recreational community.
