SUMMARY & BACKGROUND:

This Ordinance authorizes amending existing contracts due to changes in federal tariff policies that have occurred after the execution of the original contracts. Tariff changes that have occurred after bidding have increased the cost of certain imported materials or goods required for contractors to fulfill the terms of their contracts. This Ordinance only covers existing contracts. For new contracts, requests-for-proposals (RFPs) issued by city departments include language requiring contractors to include tariff-related costs in their bids. Additionally, no increase in cost paid by the city will occur without proper documentation of the tariff-tax. 

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized at his discretion to enter into amended contracts with existing vendors through the end of 2025 in order to account for verified tariff-related cost increases, upon terms and conditions acceptable to the Director of Law and the appropriate Directors of City Departments.

 

                     SECTION 2. That the expenditure of additional funds necessitated by the amendments authorized in Section 1 is authorized subject to appropriation.

 

                     SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding requirements of TMC Chapter 187 in order to avoid disruption in the procurement of goods and materials for existing contracts.

 

SECTION 4. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this Ordinance must be immediately effective to avoid disruption in the procurement of goods and materials utilized across city departments.
