Title

Authorizing the Mayor to enter into an agreement with the Lucas County Sheriff to continue to provide security for Toledo Municipal Court and Warrant Enforcement Services; authorizing the expenditure of funds; waiving TMC Section 187.24; making certain findings, and declaring an emergency.

SUMMARY & BACKGROUND:

The City’s agreement with Lucas County Sheriff’s Office to provide security services for the Toledo Municipal Court building, authorized by Ordinance 472-18, expires at the end of 2021. This Ordinance authorizes a one year term agreement with the Lucas County Sheriff to provide a multitude of services such as the staffing of Sheriff’s deputies to maintain Municipal Court building security. In addition, the agreement provides for an annual renewal with four additional one year terms. It is estimated that the cost for court security for calendar year 2022 will be $2,101,724.39. This agreement expires December 31, 2022, unless renewed.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the Mayor is authorized to execute an agreement with the Lucas County Sheriff for the continued provision of court security and warrant enforcement services upon terms acceptable to the Judges of the Municipal Court and the Director of Law including a one (1) year term with four (4) one (1) year options to renew the agreement. 

 

                     SECTION 2.                     That the competitive procurement requirements of the Toledo Municipal Code Section 187.24 are waived as it is in the City’s and the Toledo Municipal Court’s best interest to be served by the Lucas County Sheriff’s unique familiarity with court operations considering the Sheriff’s obligations to house prisoners under law.

 

SECTION 3.  The total expenditure of funds for municipal court security services shall not exceed $2,101,724.39, and is authorized from the General Fund, Account Code 1001-10800-3000257STDSTD, subject to available appropriations in future years. 

 

SECTION 4.  That the Finance Director is authorized to draw his warrant or warrants against the Account Code listed above in payment of the obligation authorized above upon presentation of the proper voucher or vouchers.    

 

SECTION 5.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the contractual arrangements must be executed in order to provide security services for Municipal Court.
