Petitioner has filed a request to vacate a portion of Clement Trace all located within the Collingwood Green, lying in the City of Toledo, Lucas County, Ohio.

NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:
SECTION 1. That the City Council does hereby declare its intent to vacate:
Legal Description of part of Clemente Trace Vacation: Being part of Clemente Trace in Collingwood Green, as recorded in Official Record 20140124-0002518, in City of Toledo, Lucas County Ohio, bounded and described as follows:
Commencing at a 1 inch iron bar monument found at the intersection of Nebraska Avenue and Division Street.
Thence South 89 degrees, 56 minutes, 09 seconds East, along the centerline of Nebraska Avenue, a distance of 278.84 feet to a point on the centerline of Rogan Way.
Thence North 00 degrees, 05 minutes, 24 seconds East, along the centerline of Rogan Way, a distance of 248.73 feet to a point on the centerline of Clemente Trace.
Thence South 89 degrees, 54 minutes, 36 seconds East, along the centerline of Clemente Trace, a distance of 30.00 feet to a point on the East 30 foot Right-of-way of Rogan Way, said point being the True Point of Beginning.
Thence North 00 degrees, 05 minutes, 24 seconds East, along the East 30 foot Right-of-way of Rogan Way, a distance of 30.00 feet to a 1/2 inch galvanized steel pipe set on the North 30 foot Right-of-way of Clemente Trace.
Thence South 89 degrees, 54 minutes, 36 seconds East, along the North 30 foot Right-of-way of Clemente Trace, a distance of 105.00 feet to a 1/2 inch galvanized steel pipe set at a point of curvature of the Northwesterly 30 foot Right-of-way of Clemente Trace.
Thence traversing in an arc to the left, along the Northwesterly 30 foot Right-of-way of Clemente Trace, having a radius of 90.00 feet, a tangent length of 125.98 feet, a central angle of 108 degrees, 55 minutes, 01 second, a chord bearing of North 35 degrees, 37 minutes, 53 seconds East, a chord distance of 146.47 feet and an arc length of 171.09 feet to a 1/2 inch galvanized steel pipe set at a point of reverse curvature of the West 30 foot Right-of-way of Clemente Trace.
Thence traversing in an arc to the right, along the Northwesterly 30 foot Right-of-way of Clemente Trace, having a radius of 380.00 feet, a tangent length of 27.39 feet, a central angle of 08 degrees, 14 minutes, 41 seconds, a chord bearing of North 14 degrees, 42 minutes, 17 seconds West, a chord distance of 54.63 feet and an arc length of 54.68 feet to a 1/2 inch galvanized steel pipe set on the South Right-of-way of Bresnahans Green.
Thence North 85 degrees, 43 minutes, 23 seconds East, a distance of 60.43 feet to a 1/2 inch galvanized steel pipe set on a point of curvature of the Southeasterly 30 foot Right-of-way of Clemente Trace.
Thence traversing a non-tangent arc to the left, along the East 30 foot Right-of-way of Clemente Trace, having a radius of 320.00 feet, a tangent length of 19.73 feet, a central angle of 07 degrees, 03 minutes, 22 seconds, a chord bearing of South 15 degrees, 17 minutes, 56 seconds East, a chord distance of 39.38 feet and an arc length of 39.41 feet to a 1/2 inch galvanized steel pipe set at a point of reverse curvature of the Southeasterly 30 foot Right-of-way of Clemente Trace.
Thence traversing an arc to the right, along the Southeasterly 30 foot Right-of-way of Clemente Trace, having a radius of 150.00 feet, a tangent length of 209.97 feet, a central angle of 108 degrees, 55 minutes, 01 second, a chord bearing of South 35 degrees, 37 minutes, 53 seconds West, a chord distance of 244.11 feet and an arc length of 285.14 feet to a 1/2 inch galvanized steel pipe set at a point of tangency of the South 30 foot Right-of-way of Clemente Trace.
Thence North 89 degrees, 54 minutes, 36 seconds West, along the South 30 foot Right-of-way of Clemente Trace, a distance of 105.00 feet to a 1/2 inch galvanized steel pipe set on the East 30 foot Right-of-way of Rogan Way.
Thence North 00 degrees, 05 minutes, 24 seconds East, along the East 30 foot Right-of-way of Rogan Way, a distance of 30.00 feet to the True Point of Beginning.
Containing 22,809.69 square feet or 0.5236 acres of land. Bearings used herein are based upon an assumed meridian and are intended to indicate angular measurement only. All 1/2 inch galvanized steel pipe set are capped with the company name and PLS No. 7476. This legal description is based upon a field survey prepared by Lewandowski Engineers on October 16, 2020.
SECTION 2. That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.
SECTION 3. That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.
