SUMMARY & BACKGROUND:
The Division of Engineering and Construction Management provides planning, engineering, and construction administration for major infrastructure improvements throughout the city, including roadways, water lines, and storm and sanitary sewers. As such, it is necessary to continue performing topographic surveys and construction staking tasks.
The division needs to replace its current Total Station instrument which is over ten years old. Ten years is a long time in survey instrument technology. It is becoming more difficult to get routine maintenance and repairs done on the equipment.
This ordinance authorizes the waiving of competitive bidding and the purchase of said equipment from Precision Laser which is the proprietary seller of Trimble equipment in the Toledo, Ohio area.
Funds for this purchase are included in the division’s 2025 operating budget.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a contract with Precision Laser for the purchase of a Trimble SX12 Scanning Total Station, upon such terms and conditions as acceptable to the Director of Transportation and the Director of Law.
SECTION 2. That the expenditure of an amount not to exceed $54,000 is authorized from the Capital Improvement Fund Account Code 5040-35000-8C35000PROSUP for the purchase of a Trimble SX12 Scanning Total Station.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the reasons that this purchase is from a proprietary seller of Trimble equipment for the Toledo, Ohio area and the Trimble equipment is compatible with existing technology currently in use by the division.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above listed Account Code in an amount not to exceed $54,000 in payment of the obligations authorized above upon presentation of proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to purchase the equipment necessary to continue performing quality survey work.
