SUMMARY & BACKGROUND:
Toledo has been accepting sanitary sewer from portions of Wood County under an agreement with the Northwestern Water and Sewer District executed on January 13, 1985. This agreement was extended one year by ordinance 627-24 to extend negotiations. The Department of Public Utilities seeks authorization to execute a new agreement. The new agreement will retain the same format of charging for sewer utilizing rates set forth in the Toledo Municipal Code.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a sewer contract with the Northwestern Water and Sewer District for a term of 40 years, upon other terms and conditions acceptable to the Mayor and the Directors of Law and Public Utilities.
SECTION 2. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that it is immediately necessary for continued acceptance of the Northwestern Water and Sewer District’s sanitary sewer.
