SUMMARY & BACKGROUND:

The City of Toledo has been awarded $500,000 through a Great Lakes Restoration Initiative grant to perform stream bank enhancements and erosion control measures along the portion of Delaware Creek that falls inside Delaware Creek Park. The rear portion of the property at 1665 Watova Rd. stretches down the ravine to the edge of the creek. Through execution of this .11-acre acquisition we will be able to perform the full scope of stream bank enhancements necessary to stabilize the creek and prevent future erosion issues.  The costs of the acquisition and associated fees are allowable expenses under the grant terms.

 

The current owner of the property has expressed a desire to sell this portion of the property to the City of Toledo.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That an amount not to exceed $10,000 is allocated from Operation Grant Fund Account Code 2016-38000-6G00312STDSTD for the purchase of real property interests and associated costs; and further authorizing the expenditure of same.

 

SECTION 2. That the mayor and the Director of Parks and Youth Services are authorized to accept bids and execute contracts or agreements for various services including, but not limited to, the purchase of the property located at 1665 Watova Rd. (Lucas County TD Parcel 16-23491), together with surveys, testing, title work, appraisals, closing costs, relocation costs, environmental assessments and other incidental fees and expenses associated with and required for the expansion of Delaware Creek Park and streambank stabilization along Delaware Creek, upon such terms and conditions as shall be approved by the Director of Parks and Youth Services and the Director of Law.

 

SECTION 3. That the Mayor is authorized to accept bids and award contracts for the purposes specified above, upon terms and conditions acceptable to the Director of Parks and Youth Services and Director of Law.

 

SECTION 4.  That the Finance Director is authorized to draw warrants against the above stated account code in payment of the obligations authorized above upon presentation of proper voucher or vouchers.

 

SECTION 5.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective to timely design and implement the necessary streambank stabilization along Delaware Creek.
