Title

SUMMARY & BACKGROUND:

The City of Toledo in a joint effort with Metroparks has successfully applied for and received funding from a Congestion Mitigation and Air Quality (CMAQ) grant from ODOT to construct a multi-use path across the MLK Bridge.  This multi-use path will connect paths on both sides of the Maumee River that are currently under construction by the Metroparks and the City of Toledo.  This multi-use path is approximately 1,618 ft. across the MLK Bridge.  The City of Toledo will administer the construction of the project.  Metroparks has allocated $1,483,659 and ODOT through TMACOG has allocated $4,237,615 for the multi-use path connection across the MLK Bridge project.  Matching funds will be provided through the Division of Road and Bridge Maintenance Matches and Planning fund.  Construction for this project is scheduled for ODOT fiscal year 2024.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

                     

SECTION 1.                      That the Mayor is authorized to enter into and execute a cooperative agreement with and accept financial assistance from the Metropolitan Park District of the Toledo Area (Metroparks) for the multi-use path across the MLK Bridge project upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.

 

SECTION 2.  That the Mayor is authorized to accept and deposit grant proceeds from Metroparks into the Capital Improvement Fund in an amount not to exceed $1,483,659 to Account Code 540G-23100-8GA7691STDSTD for the multi-use path over the MLK Bridge.

 

                     SECTION 3.  That an amount not to exceed $1,483,659 is appropriated from the unappropriated grant proceeds in the Capital Improvement Fund to the Account Code listed in Section 2; and that this amount is authorized for expenditure for the purposes set forth herein.

 

SECTION 4. That the Mayor is authorized to enter into and execute a cooperative agreement with and accept financial assistance from the Ohio Department of Transportation (ODOT) for the multi-use path across the MLK Bridge project upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.

 

SECTION 5.  That the Mayor is authorized to accept and deposit grant proceeds from ODOT into the Capital Improvement Fund in an amount not to exceed $4,237,615 to Account Code 540G-23100-8GA8635STDSTD for the multi-use path over the MLK Bridge.

 

SECTION 6.  That an amount not to exceed $4,237,615 is appropriated from the unappropriated grant proceeds in the Capital Improvement Fund to the Account Code listed in Section 5; and that this amount is authorized for expenditure for the purposes set forth herein.

 

SECTION 7.  That the Finance Director is authorized to draw their warrant or warrants against the above Account Codes in an amount not to exceed $5,721,274 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

 

 SECTION 8.   That the Mayor is authorized to prepare plans and specifications and accept bids and award contracts for the multi-use path over MLK Bridge project.  Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.

 

                     SECTION 9.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain project schedule and finance the construction of this project.
