SUMMARY & BACKGROUND:

The Ohio Environmental Protection Agency (OEPA) has awarded to the Division of Environmental Services a grant in the amount not to exceed $1,350,000 and the United States Environmental Protection Agency has awarded an OEPA pass-through grant to the Division of Environmental Services in the amount not to exceed $650,000 to continue through September 30, 2025.  These grant funds are used to cover certain operational expenses for the Air Permitting and Monitoring Section of the Division of Environmental Services.  A local match of $156,700 per year is required per the terms of this grant agreement that will be included in the 2024 and 2025 operating budget.  The General Fund will be utilized to fund this match. 

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                      That the Mayor is authorized to enter into an amended Air Grant agreement with the Ohio Environmental Protection Agency upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

 

                     SECTION 2.                       That the Mayor is authorized to accept and deposit grant proceeds into the Operation Grants Fund in an amount not to exceed $1,350,000 into Account Code 2016-38000-6G2024SSTDSTD from the Ohio Environmental Protection Agency and a State pass-through grant in an amount not to exceed $475,000 into Account Code 2016-38000-6G2024VSTDSTD and $175,000 into Account Code 2016-38000-6G2024PSTDSTD from the United States Environmental Protection Agency for the purpose of completing work necessary to carry out the terms of these grants.

 

                     SECTION 3.                       That an amount not to exceed $1,350,000 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2024SSTDSTD, an amount not to exceed $475,000 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2024VSTDSTD, and an amount not to exceed $175,000 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2024PSTDSTD; and further authorizing the expenditure of same for the purposes stated in Section 2.

 

                     SECTION 4.                      That the Mayor is authorized to accept bids and execute necessary contracts related to this amended grant upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.

 

SECTION 5.                      That the Director of Finance is authorized to issue their warrant or warrants against the Account Codes above in amounts not to exceed those authorized above in payment of the above-authorized obligations upon presentation of proper voucher or vouchers.  

                     

SECTION 6.                      That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this Ordinance must be immediately effective in order to timely receive and administer the Air Grant funds.
