SUMMARY & BACKGROUND:
Pursuant to Ordinance 215-17 the City of Toledo entered into a lease agreement with the State of Ohio, Department of Administrative Services for municipal office space in One Government Center. The State of Ohio Department of Administrative Services subsequently conveyed ownership of One Government Center to the Toledo-Lucas County Port Authority. Per Ordinance 404-18 the city entered into an amendment to the lease as requested by the Toledo-Lucas County Port Authority. The amendment has an initial term of ten years commencing January 1, 2019 and expiring December 31, 2028. The amendment contains an option for the City to renew the lease for two successive and continuous terms of five years each. In years six thru ten for the amended term the rental rate will increase 2% each year. The City now desires to amend the lease to include an additional +/- 4385 sq. ft for use and occupancy by the staff of the Department of Information Technology.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into an amendment to the lease agreement with the Toledo-Lucas County Port Authority to add additional 3rd-floor municipal office space in One Government Center and for the payment of space preparation costs, upon terms and conditions acceptable to the Director of Information Technology and the Director of Law.
SECTION 2. That the rental rate for additional space in One Government Center, 3rd Floor as set forth in the amended lease and space preparation costs in an amount not to exceed $70,000 are authorized for expenditure from Account Code 7084-17500-1144001STDSTD. Future year rental payments and costs as set forth in the lease are authorized subject to any necessary appropriation and availability of funds.
SECTION 3. That the Finance Director is authorized to draw their warrant or warrants against the Account Code authorized in Section 2 in an amount not to exceed the amounts as specified in the amended lease upon presentation of the proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in full force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that the lease and occupancy of the additional space will allow for continued cost-effective occupancy of the space by the City of Toledo of One Government Center.
