SUMMARY & BACKGROUND:
The City of Toledo has filed a request to vacate the alleys north of Western Avenue and east of Linden Street, located in the City of Toledo, Lucas County, Ohio.
NOW THEREFORE, Be it resolved that:
SECTION 1: That the City Council does hereby declare its intent to vacate the alleys north of Western Avenue and east of Linden Street, located in the City of Toledo, Lucas County, Ohio, further described below:
Legal Description of Proposed Vacation of East-West Alley (having 12.30 feet wide Right-of-Way) and a North-South Alley (having 11.66 feet wide Right-of-Way per Plat) located in River Tract Number 5 of the Township 3, United States Reserve of the Twelve Miles Square at the foot of the Rapids of the Miami of Lake Erie all in the City of Toledo, Lucas County, Ohio, being bounded and described as follows:
Beginning at the Intersection of the North Right-of-Way line of Western Ave. and the Southeast corner of Lot# 53 in the “Extension of Car Factory Addition” as recorded in the Lucas County Recorder’s Office, in Volume 2A, Page 51 in the Book of Plats, said point being the POINT OF BEGINNING.
Thence North on the East property line of said Lot# 53 to the Northeast property corner of said Lot# 53.
Thence West on the North property lines of Lots# 53 thru 49 to a point on the East Right-of-Way line of Linden Place also being the Northwest property corner of said Lot# 49.
Thence North on said East Right-of-Way line of Linden Place to a point on the South line of Lot# 54 also being the Southwest property corner of said Lot# 54.
Thence East on the South property line of Lot# 54 extended to a point on the West property line of Lot# 351 in the “Daniels Addition” as recorded in the Lucas County Recorder’s Office, in Volume 4, Page 5 in the Book of Plats.
Thence South on said West property lines of Lots# 351 and 350 to a point on the North Right-of-Way line of Western Avenue also being the Southwest property corner of said Lot# 350.
Thence West on said North Right-of-Way line of Western Avenue to a point on the East property line of Lot# 53 in said “Extension of Car Factory Addition”, said point being the southeast corner of said Lot# 53, said point also being the POINT OF BEGINNING.
SECTION 2. That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.
SECTION 3. That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.
