SUMMARY & BACKGROUND:

The Ohio Environmental Protection Agency (OEPA) has awarded to the Division of Environmental Services a grant in the amount of $1,347,358 and the United States Environmental Protection Agency has awarded an OEPA pass-through grant to the Division of Environmental Services in the amount of $558,754 to continue through September 30, 2023.  These grant funds are used to cover certain operational expenses for the Air Permitting and Monitoring Section of the Division of Environmental Services.  A local match of $156,700 per year is required per the terms of this grant agreement that will be included in the 2022 and 2023 budget ordinances.  The General Fund will be utilized to fund this match. 

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                      That the mayor is authorized to execute and enter into grant agreements with the United States Environmental Protection Agency and the Ohio Environmental Protection Agency, as necessary, on behalf of the city, upon terms acceptable to the Director of Public Utilities and the Director of Law.

 

                     SECTION 2.                       That the mayor is authorized to accept and deposit grant proceeds into the Operation Grants Fund in an amount not to exceed $1,347,358 into Account Code 2016-38000-6G2022SSTDSTD from the Ohio Environmental Protection Agency and a State pass-through grant in an amount not to exceed $456,567 into Account Code 2016-38000-6G2022VSTDSTD and $102,187 into Account Code 2016-38000-6G2022PSTDSTD from the United States Environmental Protection Agency for the purpose of completing work necessary to carry out the terms of these grants.

 

                     SECTION 3.                       That an amount not to exceed $1,347,358 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2022SSTDSTD and an amount not to exceed $456,567 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2022VSTDSTD and an amount not to exceed $102,187 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2022PSTDSTD; and further authorizing the expenditure of same for the purposes stated in Section 2.

 

                     SECTION 4.                     That the mayor is authorized to accept bids and execute necessary contracts, for the purchase of supplies, equipment, vehicles, and other necessary items to carry out the terms of these grants upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law. 

 

SECTION 5. That the Director of Finance is authorized to issue warrant or warrants against the above Account Codes in an amount not to exceed $1,906,112 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 6.                       That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the environment in the Toledo metropolitan area and for the further reason that the Ordinance must be immediately effective in order to satisfy the grant requirements.
