Rosenberg Fund; and declaring an emergency.

SUMMARY & BACKGROUND:

The City of Toledo is one of several named beneficiaries of the Leonard H. Rosenberg Trust. By reason of the death of Leonard H. Rosenberg, the Trust is operative and the Toledo Community Foundation, Inc. is prepared to begin making annual distributions to the City of Toledo.

 

In accordance with the terms of the fund agreement, $125,000 of the trust is to be used to provide funds to the Department of Parks & Recreation for maintenance and operation of its swimming pools and swim lessons. Additionally, $125,000 of the trust is to be used to benefit the Toledo Police Department to help pay for the purchase, training, and care of the dogs used in the city’s Canine Patrol Officers Unit. Annual distributions will be made from the Toledo Community Foundation to memorialize Leonard H. Rosenberg and continue the important work of improving Toledo city-owned pools and enhancing safety of Toledo by helping to pay for canine officer unit expenses.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the Mayor is authorized to execute and deliver needed instruments with the Toledo Community Foundation, Inc. and to accept and deposit distributions in the name of Leonard H. Rosenberg, into Account Code 2156-52000-3T33303STDSTD, hereby established for the benefit of Toledo Police Department for the purchase, training, and care of the dogs used in the city’s Canine Patrol Officers Unit.

 

SECTION 2. That the Mayor is authorized to execute and deliver needed instruments with the Toledo Community Foundation, Inc. and to accept and deposit distributions in the name of Leonard H. Rosenberg, into Account Code 2155-40100-7TPOOLSOPSMNT, hereby established for the benefit of the City of Toledo, Department of Parks and Youth Services to pay for the maintenance, costs, and operation of city-owned swimming pools.

 

SECTION 3. That appropriation of funds is authorized from the unappropriated proceeds of the Leonard H. Rosenberg Trust Fund’s bequest in annual distributions to the aforementioned Account Codes; and further authorizing expenditures from these accounts in compliance with the Fifth Amendment to Amended Trust Agreement of Leonard H. Rosenberg.

 

SECTION 4. That the Finance Director is authorized to draw their warrants or warrants against the above-mentioned Account Codes in payment of the above authorized obligations upon presentation of the proper documentation of the expense.

 

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary to provide needed funds for the City of Toledo Parks & Recreation and City of Toledo Police Department to pay and maintain respective operation costs for the benefit of city-owned swimming pools and law enforcement canine units.
