Authorizing the mayor to enter into sewer repair contracts to facilitate sewer repairs in all sewer districts within the public rights-of-way and/or public sanitary sewer easements; authorizing the expenditure of an amount not to exceed $5,874,000 from the Sewer Operating Fund and Storm Water Utility Operating Fund; and declaring an emergency.

SUMMARY & BACKGROUND:

This ordinance authorizes contracts for the performance of sewer repairs in sewer District 1 (North and East), Sewer District 2 (West), and Sewer District 3 (South) within the public rights-of-way and/or public sewer easements beyond the scope of what the in-house crews are capable of performing. Bids will be solicited and the best bidder(s), based upon TMC 187 and rules of the Division of Purchasing, will be awarded contract(s) in accordance with law. Funds have been identified in the 2021 operating budget to pay the anticipated cost of said sewer repairs. Contracts may be extended for up to (2) two (1) year extension periods not to exceed future years budgeted amounts and according to this ordinance.

Summary

NOW, THEREFORE,                      Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the mayor is authorized to accept bids and to enter into one (1) year contract(s) with two one-year extension options to facilitate sewer repairs in District 1, 2, & 3 within the public rights-of-way and/or public sewer easements upon such other terms and conditions as approved by the Director of Public Utilities and the Director of Law.

 

SECTION 2.  That the expenditure in an amount not to exceed $5,424,000 annually from the Sewer Operating Fund in Account Code 6070-37000-4000558STDSTD and $450,000 annually from the Storm Water Utility Operating Fund 607A-37000-4000559STDSTD is authorized for sewer repairs within the public rights-of-way and/or public sewer easements, subject to the availability and appropriation of funds in future years.

 

SECTION 3.  That the Finance Director is authorized to issue their warrant or warrants against the account codes identified in Section 2 above in an amount not to exceed $5,874,000 annually over the term of the contract(s) in payment of the obligations incurred pursuant to the contract(s) authorized in Section 1 upon presentation of the proper voucher or vouchers. 

 

SECTION 4.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to allow for the timely repairs of city sewers within the public rights-of-way and/or public sewer easements.
