SUMMARY & BACKGROUND:
The City of Toledo has been awarded a $5,500,000 grant from the Ohio Rail Development Commission (ORDC) for design and engineering of the Point Place Railroad Grade Separation project.
In 2025, the ORDC completed a planning study to evaluate eliminating at-grade railroad crossings on the CSX railroad tracks in Point Place to improve access and mobility between the Point Place peninsula and the rest of Toledo. Two preliminary alternatives identified in the study were construction of a grade separation at N. Summit Street (crossing #867115R) and E. Manhattan Blvd (867101H). Several crossings were also studied for closure.
The $5,500,000 grant awarded by the ORDC will be used to select the preferred alternative and to perform design and engineering for the project. No matching funds are required.
Passage of this ordinance is required to enable the City of Toledo to accept outside funding for this project.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute a grant agreement with and to accept and deposit financial assistance from the Ohio Rail Development Commission (ORDC) in an amount not to exceed $5,500,000 for the Point Place Railroad Grade Separation project upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.
SECTION 2. That the appropriation of an amount not to exceed $5,500,000 is authorized from the unappropriated grant proceeds in the Capital Improvement Fund to Account Code 540G-23100-8GA8649STDSTD and the expenditure of the same is authorized for the purpose in Section 1.
SECTION 3. That the Mayor is authorized to accept bids and award contracts for the Point Place Railroad Grade Separation project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Public Utilities and the Director of Law.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $5,500,000 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of this projects.
