SUMMARY & BACKGROUND:
This Ordinance authorizes the acceptance, deposit and expenditure of $2,223,050 from the Great Lakes Commission (GLC), who is the recipient of the National Oceanic and Atmospheric Administration (NOAA) funding through a cooperative agreement (U.S. Department of Commerce Award # NA19NMF4630267) entitled “Regional Partnership to Restore Fish Habitat in Priority Great Lakes Coastal Sites and Areas of Concern”. As a sub-recipient of this Award, the City of Toledo will oversee additional sub-recipients and other sub-contracted work to complete the construction of a wetland area on the PENN 7 site.

The fiscal impact of this Ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the mayor is authorized to enter into a grant agreement with the Great Lakes Commission and to accept and deposit up to $2,223,050 into the Operation Grants Fund, Account Code 2016-60500-7G02020STDSTD, for the construction of a wetland area at the PENN 7 property.

SECTION 2. That the sum of $2,223,050 is authorized for appropriation from the unappropriated grant proceeds in the Operation Grants Fund, Account Code 2016-60500-7G02020STDSTD; and further authorizing the expenditure of same for the purpose identified in Section 1.

SECTION 3. That the mayor is authorized to accept bids and award contracts for the purposes identified in Section 1.

SECTION 4. That the Director of Finance is authorized to draw his warrant or warrants against the above listed account code in payment of the above authorized obligations in an amount not to exceed $2,223,050 upon presentation of the proper voucher or vouchers.

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and so that this project can be initiated as soon as possible for property restoration.
