Title

Authorizing the appropriation and expenditure of an amount not to exceed $2,500,000 from the Local Fiscal Recovery Fund for the water main replacement project; authorizing the Mayor to prepare plans and specifications, acquire needed rights-of-way and easements as necessary, accept bids and enter into contracts; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The city has received $180.9 million through the American Rescue Plan Act (ARPA) to be used to address the public health and negative economic impacts of the COVID-19 pandemic.  The proposed amended Toledo Recovery Plan framework, which outlines the city’s projects that will be funded through ARPA, includes $5,200,000 for water infrastructure replacement and improvement. Replacement and improvement of water mains within qualified census tracts will maintain safe, reliable service that will meet the demands of the City of Toledo’s water distribution system.  This Ordinance authorizes $2,500,000 of this amount for the Broadway Street water main replacement.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1.  That the appropriation of an amount not to exceed $2,500,000 is authorized from the unappropriated balance of the Local Fiscal Recovery Fund to Account Code 2021-35000- 4WATERINFRWSB for the water main replacement on Broadway Street and further authorizing expenditure of same.

SECTION 2.  That the Mayor is authorized to prepare plans and specifications, accept bids, and enter into contracts for said project including such items as labor, materials, real estate incidentals, testing, purchase of rights-of-way and easements, equipment and professional services necessary to undertake said project. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper, and shall be subject to approval by the Director of Law and the Director of Transportation.

SECTION 3.  That the Director of Finance is authorized to issue their warrant or warrants against the Account Code listed above in an amount not to exceed $2,500,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

SECTION 4.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate this work within the ARPA timeframe and ensure uninterrupted distribution of potable water.
