SUMMARY & BACKGROUND:

This ordinance authorizes the Mayor to enter into an agreement with Cellebrite, Inc. for a five-year agreement for their proprietary Cellebrite Premium Universal Forensic Extraction Device (UFED). Cellebrite Premium is the only on-site solution in the market today that enables law enforcement to recover the passcode, unlock and perform a full file system extraction on Apple and Android devices. This contract will enable the department to reliably budget for five-years of costs related to cell phone forensics. Cellebrite, Inc. is the sole source provider of Cellebrite Premium.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to enter into a five-year software and license use agreement with Cellebrite, Inc. for Cellebrite Premium, upon terms and conditions acceptable to the Director of Police and the Director of Law. 

 

                     SECTION 2. That the total amount not to exceed $434,415.20 is authorized for expenditure from the General Fund Account Code 1001-52000-3381002STDSTD for the five year agreement. That annual payments not to exceed $86,883.04 for each of the five years are authorized subject to future appropriations.

 

SECTION 3.                       That this Council finds and determines it is in the best interest of the city to waive the competitive bidding requirements of TMC Chapter 187 for the reason that Cellebrite, Inc. is the sole-source provider for Cellebrite Premium which is a proven and reliable product essential to forensic investigations.

 

                     SECTION 4. That the Finance Director is authorized to draw a warrant or warrants against the above referenced Account Codes in payment of the obligation authorized in Section 1 and upon presentation of proper voucher or vouchers.

 

                     SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to timely support criminal investigations.
