SUMMARY & BACKGROUND:

Ordinance 275-23 authorized the Real Estate Purchase, Sale, and Development Agreement with the Board of Education for the Washington Local School District for a portion of property located at 1936 Northover Road. As part of this agreement, since a portion of the property is a delineated wetlands area, and in support of Washington Local’s water resource education objectives, the City has agreed to construct a boardwalk on the parcel as part of the property and wetlands restoration upon completion of the Water Distribution System Improvements.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the project listed below in the Water Replacement Fund is reduced of encumbrances and disappropriated.

SECTION 2. That an amount not to exceed $900,000 is appropriated from the unappropriated balance of Water Replacement Fund into Account Code 6063-32000-4UC6223STDSTD; and further authorizing the expenditure of same for the construction of a boardwalk at 1936 Northover Road.

 

SECTION 3.  That the mayor is authorized to accept bids, and execute all necessary agreements for this portion of the Water Distribution System Improvements Project as acceptable to the Department of Law.

 

SECTION 4.  That the Finance Director is authorized to issue their warrant or warrants in amounts not to exceed those authorized in Section 2 against the above-mentioned account code in payment of the obligations incurred pursuant to the agreements authorized in Section 3 above upon presentation of the proper voucher or vouchers.

 

SECTION 5.  That the disappropriation of any remaining budget to fund balance at project closeout is authorized.

 

SECTION 6. That it is found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 Ohio Revised Code.

 

                     SECTION 7.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective to facilitate the execution and delivery of the agreement and conveyances with Washington Local School District so that planned public improvements may commence in a timely manner.
