SUMMARY & BACKGROUND:
The City of Toledo has been awarded $571,342 through the Ohio Department of Development's Brownfield Remediation Program to support the environmental remediation and demolition of the former Health Department Building located at 701 Cherry Street.
The Toledo-Lucas County Health Department is in the process of relocating its operations from 701 Cherry Street to the former Diocese Building on Spielbusch Avenue. Following the relocation, the 701 Cherry Street building will no longer be needed for its current public use.
The building has been determined to be functionally obsolete and requires substantial capital investment to remain operational. Current estimates indicate that more than $10 million in improvements would be required over the next several years to address deficiencies associated with the building's plumbing, mechanical, structural, roofing, and other major building systems. Given the building's condition, anticipated capital needs, and the relocation of the Health Department, continued investment in the facility is not considered financially prudent.
The ODOD grant provides the City with an opportunity to address environmental conditions at the property and demolish the obsolete structure while significantly reducing the City's cost of doing so. Completion of the project will eliminate a deteriorating and functionally obsolete public building, reduce future maintenance and capital liabilities, address environmental concerns, and position the property for another productive reuse.
This Ordinance authorizes the City to enter into the necessary grant agreement with ODOD, accept and appropriate up to $571,342 in grant proceeds, and procure the environmental, demolition, and related professional services necessary to complete the project.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute a grant agreement with and to accept and deposit financial assistance from the State of Ohio Department of Development for the environmental remediation and demolition of the former Health Department Building at 701 Cherry Street upon such terms and conditions as approved by the Director of Public Services and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from ODOD into the Capital Improvement Fund in an amount not to exceed $571,342 to Account Code 540G-23100-8GA0122STDSTD for said project.
SECTION 3. That the appropriation of an amount not to exceed $571,342 is authorized from the unappropriated grant proceeds in the Capital Improvement Fund to the Account Codes listed above for the purposes listed above; and the expenditure of the same is authorized.
SECTION 4. That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids for the Project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary, upon such terms and conditions as acceptable to the Director of Public Services and the Director of Law.
SECTION 5. That the Finance Director is authorized to draw their warrant or warrants against the above Account Codes in an amount not to exceed $571,342 for the project in payment of the obligations incurred pursuant to the contracts authorized in Section 4 upon presentation of the proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the environmental remediation and demolition of the property.
