Declaring the necessity and intention of appropriating, in fee, a portion of the property owned by Waterford Senior Apartments, LLC, located at 4943 Angola Road and 4855 Angola Road for a sidewalk project; and declaring an emergency.
Summary
SUMMARY & BACKGROUND:
The City is proceeding with a sidewalk project on Angola Road from 4945 Angola Road to 4419 Angola Road, which will connect all of the gaps in the existing sidewalk system with new sidewalk, which will better meet the current needs of the public. The project will require the purchase of property totaling 0.0477 acres, more or less, and the temporary acquisition of property totaling 0.0057 acres, more or less, across a portion of the property located at 4943 Angola Road. Negotiations with Waterford Senior Apartments have been unsuccessful to date and it is now necessary to begin appropriation proceedings to protect the city’s interest in the rights-of-way to be acquired and keep the project on schedule.
NOW THEREFORE, Be it resolved that:
SECTION 1. That this City Council declares its intention to appropriate, in fee, a portion of the property owned by Waterford Senior Apartments LLC located at 4943 Angola Road (Parcel #0271767), respectively, as collectively more fully described on Exhibit “A” attached hereto and incorporated herein by reference.
SECTION 2. That this City Council also declares its intention to temporarily appropriate a separate portion of the property owned by Waterford Senior Apartments LLC located at 4855 Angola Road (Parcel #0271767), respectively, as collectively more fully described on Exhibit “B” attached hereto and incorporated herein by reference.
SECTION 3. That negotiations for the acquisition of the described property interests have been unsuccessful to date and that the acquisition of the property interests described in Sections 1 and 2 are necessary for the Sidewalk Gaps project on Angola Road.
SECTION 4. That it is ordered and directed that, once adopted, the Clerk of Council shall serve this Resolution as required by law, via certified mail, upon the representative(s) of the owner of the described real estate.
SECTION 5. That this Resolution is hereby declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the acquisition of the property interests from Waterford Senior Apartments LLC is necessary for the timely construction of the Sidewalk Gaps project on Angola Road.
