SUMMARY & BACKGROUND:
This Ordinance authorizes the appropriation and expenditure of $80,000 for emergency tree clearing and removal at Detwiler Golf Course and Cullen Park. Funds will be used to clear trees that were blown down or severely damaged by the June 15, 2023 tornado. Approximately 50 trees were affected by the storm and require immediate attention. The emergency action will allow the golf course to return to full operations and ensure access to the boat launch at Cullen Park.
Summary
NOW THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $80,000 is authorized from the unappropriated balance of the General Fund to Account Code 1001-40100-7741001STDSTD and the expenditure of same is authorized for emergency tree clearing and removal services at Detwiler Golf Course and Cullen Park.
SECTION 2. That the Mayor is authorized to execute the necessary contracts with The Davey Tree Expert Company for emergency tree clearing and removal services, upon such terms and conditions as shall be approved by the Director of Parks and Youth Services and the Director of Law.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirement of Toledo Municipal Code 187 for the reason that timely execution of the emergency tree clearing services will preserve the orderly function of Detwiler Golf Course and Cullen Park boat launch and that the services are going to be provided at prevailing market rates and The Davey Tree Expert Company is a sister division of the City’s current golf course management company, Davey Golf.
SECTION 4. That the Finance Director is authorized to draw warrant or warrants against the Account Code in Section 1 in payment of the above-authorized obligations in an amount not to exceed $80,000 upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and so that golf course and boat launch operations may continue in earnest as soon as possible.
