Title

Amending the Toledo Municipal Code by repealing Toledo Municipal Code Chapter 181, International Park Advisory Board; and declaring an emergency.

SUMMARY & BACKGROUND:

Ordinance 351-85 enacted a new Municipal Code Chapter 181, creating an International Park Advisory Board.  Ordinance # 431-13 added the International Park Advisory Board to the group of representatives that the Mayor shall appoint to the Toledo Parks and Recreation Advisory Board.  The area referred to is under the control of the Metroparks and has not operated as a board with valid members since 2010.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo;

 

SECTION 1. That existing Toledo Municipal Code Chapter 181 which reads as follows:

                     

181.01   Board created.

181.02   Membership.

181.03   Duties of the Board.

181.04   Organization and meetings.

181.05   Donations, gifts and membership fees.

  

181.01. Board created.

   There is hereby created the International Park Advisory Board which shall consist of twenty-one members who shall serve without compensation.

181.02. Membership.

   The membership of this Board shall be appointed by the Mayor subject to the confirmation by majority vote of Council and such appointments shall be made from, but not limited to, the various interested groups in the City as recommended by the Director of Parks, Recreation and Forestry. The members of this Board are to be appointed for three-year terms and seven members shall be appointed, annually. Vacancies in unexpired terms shall be filled in the same manner as the original appointments.

181.03. Duties of the Board.

   The International Park Advisory Board is formed to perform the following duties:

   To guide the development of an international park on the east side of the Maumee River in the area of the Dr. Martin Luther King Jr. Memorial Bridge and to serve in an advisory capacity to Council, the Mayor and the Director of Parks, Recreation and Forestry concerning, but not limited to, development of Master Plan, construction of facilities, development of programs and other such matters pertaining to the development and administration of the park as may be requested by Council. The Board shall render periodic reports and recommendations to Council as it deems necessary.

181.04. Organization and meetings.

   The Board shall elect its own president and such other officers as it deems necessary. The Board may create from its members and/or persons who are not members, associate memberships and such committees and subcommittees as it shall deem necessary to carry out the function of the Board. It shall prescribe its own rules of procedure and shall keep a record of its transactions and report annually to the Mayor and Council. It shall meet not less than once each month. The Director of Parks, Recreation and Forestry shall serve as an ex-officio member of the Board.

181.05. Donations, gifts and membership fees.

   The International Park Advisory Board is hereby authorized to accept donations, gifts and membership fees and to raise funds for the express purpose of defraying the costs incurred in its operation and duties. Any donations, gifts and membership fees so received are to be deposited with the Commissioner of Taxation and Treasury in an International Park Trust Fund. Disbursements shall be made from such trust by the Director of Finance upon presentation of proper vouchers from the International Park Advisory Board and approved by the City Department of Parks, Recreation and Forestry.

Is hereby repealed.

SECTION 2.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide for the clear and accurate commissions within the Toledo Municipal code.
