Title

Authorizing the expenditure of an amount not to exceed $75,000 from the Sanitary Sewer Operating Fund for payment to the State of Ohio for 2026 annual regulatory fees; and declaring an emergency.

 

Body

SUMMARY & BACKGROUND:

The Division of Water Reclamation is required to pay the following annual fees to the State of Ohio Environmental Protection Agency: Annual Title V Air Emissions fee; Annual Discharge fee; Annual Sewage Sludge fee; and Annual Risk Management Plan Program fee, and also required to pay Ohio Department of Health Radioactive Material license fee and Ohio Department of Agriculture for Truck scale certification.  The total cost estimate is based on previous fees paid.  They are subject to change according to the amount of fuel burned and amount of waste flow through the plant.  These fees must be paid in order for the City of Toledo to operate the Bay View Wastewater Treatment Plant. 

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the expenditure of an amount not to exceed $75,000 is authorized from the Sanitary Sewer Operating Fund Account Code 6070-36000-4000531STDSTD for payment of 2026 State of Ohio annual regulatory fees for the Bay View Wastewater Treatment Plant.

 

SECTION 2. That the Finance Director is authorized to issue their warrant or warrants in the Account Code listed in Section 1 in an amount not to exceed $75,000 upon presentation of the proper voucher or vouchers.

 

                     SECTION 3.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this Ordinance must be effective immediately in order to maintain compliance with state permits.

 

Vote on emergency clause:  yeas 10 nays 0.

 

Passed:  March 3, 2026, as an emergency measure:  yeas 10, nays 0.
