SUMMARY & BACKGROUND:
The Divisions of Traffic Management and Road and Bridge Maintenance have successfully applied for and received funding from the State of Ohio Department of Transportation (ODOT) to add or replace safety features at approximately 20 locations. These safety features include permanent rumble strips and guardrail improvements including end treatments and attenuators. The City of Toledo will administer the design and construction of the project. Matching funds will be provided through the Division of Road and Bridge Maintenance Matches and Planning fund. Design is scheduled to begin in 2026 and construction in 2029.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute cooperative agreements with and to accept and deposit financial assistance from the State of Ohio Department of Transportation (ODOT) for the Roadway Departure Safety Project upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from ODOT into the Capital Improvement Fund in an amount not to exceed $180,000 to Account Code 540G-23100-8GA0120STDSTD for the design of said project.
SECTION 3. That the Mayor is authorized to accept and deposit grant proceeds from ODOT into the Capital Improvement Fund in an amount not to exceed $1,120,280 to Account Code 540G-23100-8GA0121STDSTD for the construction of said project.
SECTION 4. That the appropriation of an amount not to exceed $1,300,280 is authorized from the unappropriated grant proceeds in the Capital Improvement Fund to the Account Codes listed above for the purposes listed above; and the expenditure of the same is authorized.
SECTION 5. That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids for the Roadway Departure Safety Project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way and construction, upon such terms and conditions as acceptable to the Director of Transportation and the Director of Law.
SECTION 6. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding requirements of Toledo Municipal Code Chapter 187 for the design portion of the project for the reason that the Ohio Department of Transportation has undertaken a competitive bid process.
SECTION 7. That the Finance Director is authorized to draw their warrant or warrants against the above Account Codes in an amount not to exceed $1,300,280 for the design and construction of the project in payment of the obligations incurred pursuant to the contracts authorized in Section 5 upon presentation of the proper voucher or vouchers.
SECTION 8. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of this project.
