SUMMARY & BACKGROUND:
The Basin 8 Flocculation and Sedimentation Basin Project is now completed for less than the original budget and eligible for closing and disappropriation. The City of Toledo has previously engaged in the design of a replacement Raw Water Main to update one of the existing aging raw water mains that was installed in 1940 and is reaching the end of its useful life. The replacement of the raw water main is critical to ensure a continued reliable water supply to the Toledo region. The new raw water main is designed to be installed parallel to the existing mains, allowing construction to proceed without interrupting continuous water service. This will require the acquisition of additional real property, additional temporary and permanent easements, updates to existing easements and compensation to restore property and crop loss along the nine (9) mile route of the Raw Water Main.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the disappropriation of $183,806 is authorized from the Water Bond Improvement Fund Account Code 6062-32000-4UB1916STDSTD Basin 8 Flocculation and Sedimentation Basin Project.
SECTION 2. That the appropriation of $183,806 is authorized from the Water Bond Improvement Fund to Account Code 6062-32000-4UB1826STDSTD and the expenditure of an amount not to exceed $183,806 is authorized for real estate acquisition and other associated cost for the Raw Water Main Project.
SECTION 3. That the Mayor is authorized to accept bids and execute the necessary contract(s) or agreements for real estate acquisition and associated services including, but not limited to, the purchase of property, easement acquisition, easement updates, crop damages, property restoration costs, surveys, testing, title work, appraisals, closing costs environmental assessments and other incidental fees and expenses related to the Raw Water Main Project upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code listed in Section 2 in an amount not to exceed $183,806 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance at project closeout is authorized.
SECTION 6. That this Ordinance is hereby declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be effective immediately in order to maintain the supply of potable water to the region in an efficient manner.
