City of Toledo, Case No. 3-23-cv-01641 pending in the United States District Court, Northern District of Ohio; waiving the competitive bidding provision of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
Due to CliftonLawsonAllen LLP having particularized expert knowledge in this matter, it has been retained to assist the City of Toledo in the above-entitled action.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a professional service agreement with CliftonLawsonAllen LLP upon terms and conditions acceptable to the Director of Law.
SECTION 2. That the expenditure of an amount not to exceed $30,000 is authorized from the Risk Management Fund, Account Code 7095-12000-1157001STDSTD, for the purposes identified in Section 1.
SECTION 3. That Council finds and determines it is in the best interest of the City to waive competitive bidding provision of TMC Chapter 187 for the reason that CliftonLawsonAllen LLP was identified through an informal selection process and time is of the essence in their retention.
SECTION 4. That the Director of Finance is authorized to draw their warrant or warrants against Account Code 7095-12000-1157001STDSTD in payment of the obligations authorized in Section 1 above upon presentation of the proper voucher or vouchers.
SECTION 5. That this ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of public peace, health, safety and property and for further reason that this ordinance must immediately be effective so the City may timely cooperate with the federal investigation and promptly pay obligations incurred for the delivery of expert services.
