Body

SUMMARY & BACKGROUND:

The city of Toledo, in partnership with the Toledo-Lucas County Port Authority, the Metropolitan Park District of the Toledo Area, and Lucas County Land Bank Reutilization Corporation (“Coalition of Partners”) was awarded a U.S. EPA Assessment Coalition grant in the amount of $600,000 for the purpose of completing environmental site assessment work on brownfield properties in Toledo and Lucas County. The Coalition of Partners has identified target areas, including the Monroe St./Detroit Ave. Corridor; Swan Creek/Warehouse District; Cherry St. Corridor; Maumee River Corridor.  Additional sites outside target areas are also eligible for assessment funding. 

 

The city will, on behalf of the Coalition of Partners, enter into a Cooperative Agreement with the U.S. EPA. This ordinance authorizes the mayor to enter into necessary agreements, and to accept, deposit, appropriate and expend the $600,000 in grant funds.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                      That the mayor is authorized and directed to execute and deliver on behalf of the city, the grant agreement with the U.S. EPA. 

 

                     SECTION 2.                      That the mayor is authorized to enter into a Memorandum of Agreement with the Toledo-Lucas County Port Authority, the Metropolitan Park District of the Toledo Area, and Lucas County Land Bank Reutilization Corporation for the purpose of completing environmental assessment activities in the Toledo area.

 

                     SECTION 3.  That the mayor is authorized to accept and deposit grant proceeds in the amount of $300,000 into the Operation Grants Fund to Account Code 2016-38000-6G10407STDSTD (18 Hazardous Assessment Grant); and that the mayor is further authorized to accept and deposit grant proceeds in the amount of $300,000 into the Operation Grants Fund to Account Code 2016-38000-G610408TDSTD (18 Petroleum Assessment Grant) for the purpose of completing environmental site assessment activities in the Toledo area in conformance with the Grant Agreement.

 

                     SECTION 4.   That the appropriation and expenditure of an amount not to exceed $300,000 is authorized from the unappropriated grant proceeds of the Operation Grants Fund in Account Code 2016-38000-6G10407STDSTD (18 Hazardous Assessment Grant) and that the appropriation and expenditure of an amount not to exceed $300,000 is authorized from the unappropriated grant proceeds of the Operation Grants Fund in Account Code 2016-38000-6G10408STDSTD (18 Petroleum Assessment Grant) for the environmental site assessment work.

 

                     SECTION 5.  That the mayor is authorized to accept bids and execute necessary contracts, after due advertising according to law, for the completion of environmental assessment activities in the Toledo area upon such terms and conditions shall be approved by the Director of Public Utilities and the Director of Law. 

 

                     SECTION 6.                     That the Finance Director is authorized to issue her warrant or warrants against the Account Codes identified in Section 4 above in amounts not to exceed $600,000 in payment of the obligations above upon presentation of proper voucher or vouchers.  

 

                     SECTION 7.  That the disappropriation of any remaining budget is authorized at project closeout. 

 

SECTION 8.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to timely complete environmental site assessment activities which will help to create or preserve jobs and employment opportunities and improve the economic welfare of the people of the City.
