Declaring a Moratorium until June 1, 2020, on the authority of the City of Toledo Department of Finance, Division of Taxation and Treasury to accept new applications for a license to operate a Sweepstake Terminal Café (TMC Ch. 736) or Coin Amusement Devices and Amusement Centers (TMC Ch. 737) and the Toledo- Lucas County Plan Commission to accept applications for Special Use Permits under 1104.2500 for Sweepstake Terminal Cafes; and declaring an emergency.

SUMMARY & BACKGROUND:
The purpose of this moratorium is to further study the licensing and Special Use Permit Process for Sweepstake Terminal Cafes in the City of Toledo. The uncontrolled proliferation of Sweepstake Cafes is having a detrimental impact on the health, safety and welfare of its citizens and visitors. Desiring to protect the Individuals rights, while protecting its citizens from certain activities and influences, which could result in irreparable harm. This city Council has a legitimate interest in protecting its citizens from unethical business practices, and ensuring safe locations while protecting the integrity of its neighborhoods.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the authority of the City of Toledo Department of Finance, Division of Taxation and Treasury to accept new applications for a license to operate a Sweepstake Terminal Café (TMC Ch. 736) or Coin Amusement Devices and Amusement Centers (TMC Ch. 737) is hereby suspended until June 1, 2020.
SECTION 2. That the authority of the Toledo Lucas County Plan Commission to accept new applications for a Special Use Permit to operate a Sweepstake Terminal Café under 1104.2500 is hereby suspended until June 1, 2020.
SECTION 3. That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason being that a moratorium is necessary to allow time to review additional Licensing Regulations and Special Use Permit standards for Internet Cafes.
