Title
Appropriating money for current ordinary expenditures of the various departments for the City of Toledo for February 2023; and declaring an emergency.

SUMMARY & BACKGROUND:
It is not deemed advisable to enact an annual appropriation ordinance at this time. It is necessary to pass a temporary appropriation measure for meeting the ordinary expenditures of the municipality for February 2023. The February appropriation reflects 1/12th of the proposed 2023 budget, plus additional appropriation for upcoming expenditures that exceed this amount. These are reported on the Attachment A. Additionally, this temporary appropriation includes funding for seven new position requests for the Department of Parks, Recreation and Youth Services and the Department of Public Service. Funding for these positions is requested now so that the hiring process can begin and positions can be filled before the upcoming mowing and park maintenance season.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That sufficient funds are appropriated out of the tax and other revenue due the City of Toledo to provide for the meeting of current payrolls and payment of any and all other proper legal obligations of the City of Toledo for February 2023.
SECTION 2. That the sums appropriated and all expenditures made under this ordinance shall be charged against the appropriation made in the annual appropriation ordinance for the fiscal year 2023 when passed.
SECTION 3. That there is appropriated from these various funds to the accounts included in Attachment A, which is incorporated herein by reference; position control is limited to those positions authorized and funded as of December 1, 2022 with the exception of those positions funded and itemized on Attachment A.
SECTION 4. That out of the funds appropriated herein, the Mayor is authorized to expend the necessary funds which may be in excess of $10,000 in payment of the following obligations as deemed necessary: (1) utility bills; (2) taxes; (3) postage; (4) rent for building space pursuant to existing multiple year contracts and leases; (5) Criminal Justice Coordinating Council bills; (6) criminal justice and emergency management agency charges from Lucas County; (7) Lucas County 911-Regional Council of Governments payments; (8) medical and workers’ compensation payments; (9) payments to Lucas County Solid Waste Management for refuse collection and disposal fees (10) Ohio Environmental Protection Agency fees associated with waste disposal and; (11) debt obligations and related service charges.
SECTION 5. That the Mayor is authorized to make administrative transfers of funds under $25,000, within the personnel service line item accounts (51000 series) and is also authorized to transfer funds within other account codes (52000, 53000, 54000, and 55000 series), exclusive of transfers between the personnel service codes and the other account codes or between organizations and funds.
SECTION 6. That the Finance Director is authorized to draw his warrant or warrants against the appropriations set forth upon presentation of proper vouchers.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to continue services provided by the City of Toledo.
