Authorizing the annual expenditure of an amount not to exceed $20,000 from the Sewer Operating Fund and $20,000 from the Water Operating Fund to provide payment for annual membership fees to Ohio Utilities Protection Service (OUPS); and declaring an emergency.

SUMMARY & BACKGROUND:
Per ORC 3781.26(A), the Division of Sewer & Drainage Services and the Division of Water Distribution are required to be members of an underground protection service. Ohio Utilities Protection Service (OUPS) is the service provider in Ohio and provides notification to mark locations for individuals and contractors who are going to dig and helps to ensure the safety of individuals and contractors doing construction. This Ordinance authorizes payment of the annual membership fees for the divisions.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That subject to appropriation the expenditure of an amount not to exceed $20,000 is authorized annually from the Sewer Operating Fund Account Code 6070-37000-4000510ADMSUP for payment of the City of Toledo Department of Public Utilities, Division of Sewer & Drainage Services membership fees to the Ohio Utilities Protection Service.
SECTION 2. That subject to appropriation the expenditure of an amount not to exceed $20,000 is authorized annually from the Water Operating Fund Account Code 6060-34000-4000514STDSTD for payment of the City of Toledo Department of Public Utilities, Division of Water Distribution membership fees to the Ohio Utilities Protection Service.
SECTION 3. That the Finance Director is authorized to issue their warrant or warrants against the Account Codes and amounts identified in Sections 1 and 2 for payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that expenditure is needed for prompt payment of the Department of Public Works OUPS fees.
