Authorizing the Mayor to execute an Amended Land and Right of Way License Agreement with Columbia Gas of Ohio, Inc. for certain land owned by the City of Toledo that is located in the Maumee Riverfront-Riverfront Northwest; authorizing the receipt and deposit of revenue income; and declaring an emergency.

SUMMARY & BACKGROUND:
Columbia Gas of Ohio, and the City of Toledo originally entered into a 30-year License Agreement on August 20, 1991, legally described in “Exhibit A”, pursuant to Ordinance No. 629-91, (Exhibit “B”), for certain property known as Maumee Riverfront, Riverfront Northwest, L.W.C.F. Project No. 39-00632, for the installation and maintenance of underground pipe line and casting for conveying natural gas in, upon, under, over, along, above, within and across a portion of City-owned property.
This legislation seeks to authorize the License Amendment of original agreement and the acceptance and deposit of a one-time renewal fee in the amount of Thirteen Thousand Thirty-One Dollars and 23/100 ($13,031.23). In addition, this License Amendment incorporates one thirty-year renewal term. This request for an amended license renewal has been determined to be in the best interest of the City of Toledo to formalize the continued operation of this gas regulator site by entering into an amended license agreement. Both parties have mutually agreed to a thirty-year term Amendment, effective September 26, 2021, expiring September 27, 2051 (the “Term”).
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to execute a First Amendment Land License Agreement on behalf of the City of Toledo to Columbia Gas of Ohio, Inc. for certain property known as Maumee Riverfront, Riverfront, Riverfront Northwest, L.W.C.F. Project No. 39-00632, as described in Exhibit “A”.
SECTION 2. That Amended License Agreement shall be for a thirty (30) year term, effective with execution of said Agreement, for the amount of Thirteen Thousand Thirty-One Dollars and 23/100 ($13,031.23), due upon execution of this agreement, for the purpose of operating and maintaining lessee’s pipeline and gas regulator station.
SECTION 3. That the Director of Finance is authorized and directed to receive and deposit revenues from said Amended License Agreement into the General Fund Account Code 1001-35000-5651001STDSTD.
SECTION 4. That Amended License Agreement shall contain other terms and conditions deemed necessary and proper by the Mayor, the Department of Law, the Department of Development and the Department of Parks and Youth Services.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public health and safety and for the further purpose of allowing Columbia Gas to proceed with installation of required gas regulator site.
