SUMMARY & BACKGROUND:

The Division of Streets, Bridges & Harbor is responsible for maintenance and repair of many bridges and two (2) levee systems within the City of Toledo. This equipment will be used to assist crews in repairing and maintaining these city bridges and levees.

 

The fiscal impact of this Ordinance is as follows:

The total amount to be expended in the above schedule is not to exceed $99,057.00.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That an amount not to exceed $99,600 is authorized for expenditure from the Street Construction, Maintenance and Repair Fund, Account Code 2014-23100-2431001STDSTD for the purchase of equipment for the Division of Streets, Bridges & Harbor.

 

SECTION 2. That the Mayor is authorized to enter into a contract with Alta Equipment Company for the purchase of one (1) Avant Loader with attachments, upon terms and conditions acceptable to the Director of Public Service and the Director of Law.

 

SECTION 3. That this Council finds and determines it is in the best interests of the City to waive the competitive procurement requirements of TMC Chapter 187 for the reason that given current equipment market conditions Alta Equipment Company is exclusively able to deliver the equipment to the City on a timely basis for the Division of Streets, Bridges and Harbor to be able to carry out its bridge and levee programs.

 

SECTION 4.  That the Finance Director is authorized to draw his warrant or warrants against the Account Code listed in Section 1 in a total amount not to exceed $99,600 in payment of the above authorized obligations upon presentation of properly approved voucher or vouchers.

 

SECTION 5.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to ensure that the vehicular fleet is equipped in a fashion supportive of continuous daily city services to the community.
