SUMMARY & BACKGROUND:
The Division of Water Reclamation is attempting to restore the dry weather facility’s Grit Removal Process to reliable operation, however, as a result of deferred maintenance, there are multiple failures in the six tanks that are part of the process; the cause of breakdown in each tank cannot be investigated without draining and cleaning each tank. Tanks with broken equipment have to be available for service during rain events to assure hydraulic capacity of the plant; as a result, the division needs options to supplement their workforce as needed by contracting out work to repair the tanks and the flexibility to order parts immediately once the problem is determined.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of an amount not to exceed $500,000 is authorized from the Sewer Replacement Fund to Account Code 6073-36000-4UC3226STDSTD and the expenditure of the same is authorized for emergency repairs to the Grit Process at the Water Reclamation Facility.
SECTION 2. That the Mayor is authorized to enter into contracts as needed to supplement plant crews and order parts as soon as the need is determined for emergency services at the Water Reclamation Facility, upon terms and conditions approved by the Director of Public Utilities and the Director of Law.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive provisions of TMC Chapter 187 for the reason that plant staff does not have sufficient resources to repair the multiple failures present at one time and does not know which parts are required until teach tank is drained and will need to supplement their staff by contracting out some or all of the work and to procure parts immediately once the cause of failure is discovered.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $500,000 in payment of the obligations authorized herein upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance at project closeout is authorized.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate prompt payment for emergency services at the Water Reclamation Facility.
