SUMMARY & BACKGROUND:
Failure of a landfill gas (LFG) inlet valve on the flare skid at the Hoffman Road Landfill caused a shutdown of the flare, compromising the operation of a critical environmental control. Federal regulations and the landfill’s air pollution control permit have strict compliance requirements regarding the management of landfill gas. A total system shutdown presents significant environmental compliance and operational risks associated with the interruption of active landfill gas management. This required immediate action to restore system operation. APTIM has the specialized knowledge and expertise as the original equipment manufacturer and installer to repair and expedite restoring operation of the landfill gas system.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a contract with APTIM (dba LFG Specialties) for emergency repair services on the landfill gas flare at the Hoffman Road Landfill, upon terms and conditions approved by the Director of Public Service and the Director of Law.
SECTION 2. That the expenditure of an amount not to exceed $15,000 from the Solid Waste Trust is authorized from Account Code 2090-24500-6T23201STDSTD for emergency repair services to the landfill gas flare at the Hoffman Road Landfill.
SECTION 3. That Council finds and determines that it is in the best interest of the City to waive the competitive bidding provision of TMC Chapter 187 for the reason that immediate repairs were needed to maintain environmental compliance and reduce operational risks associated with the interruption of active landfill gas management.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $15,000 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to pay APTIM (dba LFG Specialties) for emergency repair services related to landfill gas flare at the Hoffman Road Landfill.
