Title
Authorizing the Mayor to accept, deposit, appropriate and expend the HOME Investment Partnerships Program American Rescue Plan Act of 2021 (HOME-ARP) Grant in the amount of $395,046.60 from the U.S. Department of Housing and Urban Development (HUD) for the purpose of funding the HOME-ARP Program; and declaring an emergency.

SUMMARY & BACKGROUND:
The City of Toledo (COT) has received an allocation of $7,900,932 of HOME-ARP funding to provide housing, services and shelter to individuals experiencing homelessness and other vulnerable populations. Pursuant to the HOME-ARP Grant Agreement and Requirements for the Use of Funds in the HOME-American Rescue Plan Program (“Notice”), a participating jurisdiction is provided up to five percent of its total allocation for administrative and planning costs including the development of a HOME-ARP Allocation Plan. Once the HOME-ARP Allocation Plan is developed and approved by the City Council and HUD, the remaining HOME-ARP Grant will be made available.
This Ordinance is to authorize the Mayor to accept the five percent of HOME-ARP funding from HUD, deposit the HOME-ARP funds received from HUD into the appropriate Account Codes, and expend the amount of $395,046.60 of HOME-ARP funding for administrative and planning costs including the development of a HOME-ARP Allocation Plan.
The financial impact of this Ordinance is the receipt of $395,046.60 from HUD to the City of Toledo to provide housing, services and shelter to individuals experiencing homelessness and other vulnerable populations.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to accept the five percent of HOME-ARP funding from HUD, deposit the HOME-ARP funds received from HUD into the into Account Code 2025 16200 407400 5GH3002STDARP (Toledo HOME-ARP Program Fund), and expend the amount of $395,046.60 of HOME-ARP funding for administrative and planning costs including the development of a HOME-ARP Allocation Plan.
SECTION 2. That the appropriation for $395,046.60 is authorized from the unappropriated grant proceeds in the Toledo HOME-ARP Program Fund.
SECTION 3. That the Mayor and the Director of the Department of Housing and Community Development are authorized to enter into the necessary contracts or agreements to implement HOME-ARP administrative and planning activities including development of the HOME-ARP Allocation Plan.
SECTION 4. That the Finance Director is authorized to issue his warrant or warrants against Account Code 2025 16200 5GH3002STDARP in an amount not to exceed $395,046.60 in payment of all obligations authorized under the HOME-ARP Program administrative and planning funds upon presentation of properly approved documentation.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency is the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to allow the City of Toledo to implement HOME-ARP administrative and planning activities including development of a HOME-ARP Allocation Plan.
